HomeMy WebLinkAboutSDP202000029 Correspondence 2020-04-14H5, LLC PO Box 7664 Charlottesville, VA 22906 April 14, 2020 To: Elemental Ecotech, LLC - VIA UPS Overnight and First- Class Mail Kevin O'Brien 809 Bolling Avenue, Unit C Charlottesville, VA 22902 Chris Donalson - First- Class Mail 24 Canterbury Rd Charlottesville, VA 22903 To whom it may concern: This letter serves notice that H5, LLC is the current owner of the property at 1725 Broadway Street, Charlottesville, VA 22902 and successor as Grantor to Yves Delorme, Inc. as Grantor pursuant to that certain Deed of Easement and Road Maintenance Agreement dated August 1, 2016 (the "Easement") and recorded in Deed Book 4797, page 416 in the Albemarle County Clerk's Office. A copy of the recorded easement is attached. Please update your address records accordingly for future notices. According to the Easement, the temporary construction easement to commence building the Front and Side Roads within the Limits of Disturbance on our property expired on August 5, 2019. We notified Mr. Donalson in February that someone had placed stakes on our property and asked that If that person or entity is associated with Elemental Ecotech, LLC, to have them remove the stakes. Mr. Donalson said he had no one placing stakes on the H5, LLC property. Now, we find by Notice Letter from Albemarle County dated March 31, 2020 that a Major Site Plan Amendment is being considered for your property now entitled "Woolen Mills Industrial Park" and it appears that travel ways are now being planned over the H5, LLC property. Please be advised that we do not agree to your use of the H5 Property for any purpose whatsoever and certainly not for constructing access roads to your property. Other than to remove the stakes, any further entrance on to the H5 Property may be considered as trespassing.
