The approval of the preliminary site plan is valid for (1) one year in accordance with Zoning Ordinance Section 32.4.3.1. Therefore, the preliminary approval shall expire September 9, 2006. If the preliminary site plan approval expires, a new application must be filed and processed. Please address all of the requirements and conditions listed below and submit eight (8) tentative final plan copies, with the appropriate application and fee, to the Department of Community Development. This letter must be submitted with the tentative plans, as a checklist, to document that you have addressed all requirements or conditions, or the tentative plan will be denied. The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan, with the associated applications and fees, may also be submitted with the eight (8) tentative Plans. Failure to do so will result in a separate application to be filed with the Engineering Department at a later date. After the initial tentative plan submittal, each department /agency will contact you to discuss any remaining conditions. After all aforementioned department /agencies have granted a tentative approval, you may submit the final mylars (2 sets) and one blueprint copy to the Department of Community Development by 5:00 p.m. on any Monday. Assuming that the final site plan mylars reflect all tentative approvals, signing of the plans will occur within one week. The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in addition to the following conditions. The Department of Community Development shall not accept submittal of the final site plan for signature until tentative approvals for the following conditions have been obtained. The final site plan shall not be signed until the following conditions are met: A. Division of Zoning and Current Development: Zoning and Planning approval to include: (contact Yadira Amarante 296 -5832) ❑ [18.32.6] The final site plan, in addition to reflecting all the requirements of 32.5.6 (preliminary site plan requirements), must also reflect all final site plan requirements. ❑ [Proffer #1] You must establish open space proportional to the aggregate number of dwelling units shown on this site plan. Open space must be labeled, dimensioned by metes & bounds including area and set apart on the site plan. Open space is not labeled on sheets 3 and 4. ❑ [Proffer #6] This proffer limits areas of disturbance to those needed for structures, utilities, pedestrian ways, recreation areas, roads and other improvements. All other areas must remain in their natural states. Please provide a conservation plan on the landscape plan. The conservation plan checklist attached, it must be filled out, signed by the owner of the property and incorporated into the landscape plan. The landscape plan/conservation plan will be reviewed at final. ❑ [Proffer #10] This proffer requires that the rears of all townhouse units located on double frontage lots be screened per section 32.7.9.8 of the zoning ordinance. This section of the ordinance requires that if vegetative screening is provided, that the planting material must be located in a 20' wide screening strip consisting of a double staggered row of evergreen trees planted 15' on center. The landscape plan will be reviewed at final. ❑ [Proffer #11] This proffer requires that 25 for sale townhouses are affordable and the owner of the property must enter into a contract with the county to ensure that this happens. Please contact Ron White, Director of Housing at 296 -5839 to begin this paperwork. ❑ [18.4.6.3] Front yards /setbacks must be measured from the right of way line of the public street or private road. ❑ [18.4.7.4] Open Space shall be protected by legal arrangements to ensure its maintenance and preservation. Please submit covenants meeting the requirements of Section 14 -313 of the Subdivision Ordinance. These agreements are subject to County Attorney review and approval. Again, open space must be labeled, dimensioned by metes & bounds including area and set apart on the site plan. Among other requirements, you will be required to plat these tracts of open space prior to approval of the final site plan. ❑ [18.4.12.6] There are additional parking requirements for recreational areas. Existing recreational areas are exempted from any new requirements; however, all new /proposed recreational amenities must have parking as stipulated in this section of the ordinance. I apologize for not catching this earlier. ❑ [I8.4.12.16.c.I] Travelway aisles adjacent to parking spaces on either side must be 24' wide. Now that you've provided the width of the proposed travel -way aisles (22') they are not wide enough in most cases. ❑ [ 18.4.15.13] Be aware that all signs will require separate permits under 4.15 of the zoning ordinance. ❑ [18.4.16.2] There is one tot lot shown on the site plan. There is a requirement for 1 tot lot for the first 30 units and then I for each additional 50 units. At 161 proposed units the requirement is for 3 tot lots. Regardless of the proffered specific location (phase IB), you are required to provide at least 2 more tot lots per the ordinance. Equipment required for each tot lot is as follows: One (1) swing (four (4) seats) One (1) slide Two (2) climbers One (1) buckabout or whirl Two (2) benches Each tot lot shall consist of at least 2,000 square feet and shall be fenced Show tot lot equipment details and fencing on the plan. Also, state what kind of ground cover will be used. If you do not want to provide these additional tot -lots please submit a substitution request letter per Section 4.16.2.1 of the zoning ordinance. ❑ [I 8.32.5.6.a] The setbacks requested by Mr. Wood were approved by the Board of Supervisors on 7/13/05. The setbacks reflected on the site plan should be as follows: 12' minimum building separation; 6' side yards; 5' rear yards; 20' front yards. Please revise the plan accordingly (the notes on sheet 1 and on the individual lots). ❑ [ 18.30.6] The final plan approval is subject to the issuance of a Certificate of Appropriateness from the Architectural Review Board. ❑ [18.32.5.6.b] Provide maximum height of all structures. The maximum legal height is 35'; 65' is reserved for commercially zoned property. ❑ [I 8.32.5.6.b] The parking tabulation table must be revised. You must show those spaces that are intended to be in garages or private driveways, (these spaces are usually identified with an icon of a car). Also, in phase lb -1 I counted 53 surface spaces, in phase 8 I counted 145 surface spaces. ❑ [18.32.5.6.1] On sheet 4 label the storm sewer easement which runs parallel to the western boundary of phase 1 A -1. ❑ [18.32.5.6.1] On sheet 4 show and label the sanitary sewer easement which runs in front of lots 6 through 21. ❑ [18.32.5.6.n] Dimension and label the following: buildings (maximum footprint and height). The typical on sheet 2 is showing lots not the buildings. The maximum height note on sheet 1 is incorrect. ❑ [18.32.5.6.n] Show and label all proposed sign locations (street signs, subdivision signs, parking signs, etc.). ❑ [18.32.5.6.0] Indicate (by labeling) all areas to be dedicated or reserved for public use. ❑ [18.32.5.6. s] Prior to final site plan approval a plat will be required to create all necessary right -of -ways to be dedicated to public use, easements (private road, swm, utility, sight distance), and open space. A separate application and fee will be required for this review. ❑ [ 18.32.5.6(n)] [ 18.32.6.60)] [ 18.32.6.60)] [ 18.4.17.4(b)] Show the location of all outdoor lighting on the plan. Provide a description and photograph or diagram and show the location of each type of outdoor luminaire that emits 3,000 or more initial lumens. Please be aware that installation of such luminaires in the future that are not shown on this plan shall require an amendment to this plan. Include a photometric plan on the site plan demonstrating that parking area luminaires are in compliance with 4.17.4 b. If no outdoor lighting is proposed, or the outdoor lighting does not emit 3,000 or more initial lumens, please provide a note to this effect on the plan. ❑ [18.32.7.2.8] In addition to the sidewalks required by Proffer #5, you must provide sidewalks along both or one side of each private and or public road which serves each townhouse or duplex unit. In phase 8 please continue the sidewalk along lots 13 through 20 and along the SWM pond to connect lots 104 and 105. In phase 1 a -1 connect the sidewalk from Lot 6 to 5. In phase 1B -1 continue the sidewalk from lot 1 to Briarwood Drive, at the end of this sidewalk provide a crosswalk to allow the residents of phase 1 a -1 to use the tot lot in phase lb -1; also continue the sidewalk from lot 7 to 6 and extend the sidewalk in front of units 15- 22 to include the tot lot. ❑ [Comment] Please be consistent when identifying the phases. For example, in the title of the plan you call out phases 1 a and 1 b; in the parking schedule you call out phase 1 a but then phase lb -1; the numbers shown different on the proposed/existing lot mix table and then differently again on the sheets showing the individual phases. For whatever it's worth I like the IA-1 and 113-1 since they identify sub - phases. B. Division of Zoning and Current Development: Engineering approval to include: (contact Steven Snell 296 -5832) ❑ Easements for off site facilities and grading will be required before final site plan approval can be given. ❑ Engineering for current development needs to review and approve all applicable items as specified in the Design Standards Manual, section 902, before recommending tentative approval to the final site plan. C. Division of Planning: E911 approval to include: (contact Andrew Slack 296 -5832) ❑ The road names listed below are not approved road names. Albemarle County Service Authority approval to include: (contact Gary Whelan 977- 4511) ❑ Final approval will not be granted until water and sewer construction plans have been reviewed and approved.
