Subject: SUB202000072 — TMP 93-11 —Family Subdivision
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat
referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
1. [14-302(A)(3)] Existing streets. On Sheet 2, include 'SR 762' under 'to Rose Hill Church
Lane', to be clear that this connects to a public ROW.
2. [14-302(A)(3)] and [14-403] Streets and frontage. Frontage is required for the new Lot 1.
There are two options for frontage:
a. Either: Provide the plat/recordation showing that the `existing road' is an existing
private street approved by the County. See attached correspondence referencing
DB 84 PG 373. If this is an existing private street, label it as `existing private
street' and include the DB/PG creating the private street on the plat.
b. Or: Label as `new private street' and extend the private street from new Lot 1 to
the public ROW (SR 762). In this case, the owner of TMP 93-12 will also need to
sign the plat.
3. [1 4-302(A)(1 0)] Development rights. Revise the development rights notes to include the
following: "The residue of Tax Map Parcel 93-11 is retaining four (4) development rights
and may be further divided."
4. [1 4-302(A)(1 1)] Instrument that created the property. Include the deed book and page
number of the instrument whereby the property was created (not just the most recent
instrument).
5. [14-302(B)(8)] Setbacks. Revise and include the correct setbacks for the RA zoning
district:
Sec. 10.4 - Area and bulk regulations.
Area and bulk regulations within the RA, rural areas, zoning distridare as follows:

6. [14-302(B)(10)] Stream buffers. Show/label the stream buffer on the plat and include the
required note to meet the following requirement: The location of stream buffers required
by the water protection ordinance, with the following note: "The stream buffer(s) shown
hereon shall be managed in accordance with the Albemarle County Water Protection
Ordinance."
7. [14-312] Location of existing buildings. Show the location of the existing dwelling unit on
TMP 93-11.
8. [14-309] and [14-310] Health Director Approval. Approval from the Health Director is
required for this application. The necessary information has been transmitted to the
Health Director and is under their review.
9. [14-212] Family subdivisions; conditions of approval. The family declaration is still
needed for review. County Attorneys Office review and approval is required for the family
division declaration and affidavit.
10. [14-212(B)] Family subdivisions; conditions of approval. In order to add the requested
daughter-in-law to the family division, a letter from a lending institution is required.

11. [Comment] Private street maintenance agreement (recommended). While private street
maintenance agreements are not required for family subdivisions, the County does
recommend them. It can facilitate future real estate transactions to have the agreement
officially recorded. Please let staff know if you wish to be sent the template to complete.
