- The proposed use requires a submittal of a Special Use Permit as per 18.24.2.2.4 of the
Zoning Ordinance.
- Submittal of an application for a Special Exception for a waiver/modification of the of
Supplementary Regulations 5.1.11.13 for the minimum of 200 feet distance of use from
residentially zoned properties.
- As potential noise impacts will likely be the primary use impact issue to be addressed
for this proposal, it is strongly recommended that technical information
(studies/assessments/etc.) regarding noise attenuation from building design (proposed
renovation/construction methods), or site characteristics/design be provided with the
initial application submittal. Estimates of noise impacts at the less -than 200 residentially
zoned property lines will be an important to the evaluation of the requested Special
Exception.
- SP201700030, Willow River Veterinary Services (Mill Creek) is a similar request recently
reviewed and approved by the Board of Supervisor (including a Special Exception from
5.1.11.B).

CERTIFICATE OF PLAT, COVENANTS, AND NAINrENANCE AGREEKENT
Attached hereto is a plat of S. L. Key, Incorporated, Land
Surveyor, dated September 16, 1996, last revised September 30,
1996, entitled "Plat Snowing a Subdivision of Lot 'C'". The
following covenants are imposed upon the properties shown on the
attached plat and shall run with the respective lots or parcels
shown.
1. The Declaration of Covenants and Restrictions for Forest
Lakes of record in the Clerk's Office of the Circuit Court of
Albemarle County in Deed Book 1071, beginning at page 498, if not
previously imposed, is hereby imposed upon Lots 1, 2 and 3 as shown
on the attached plat.
2. Lots 1, 2 and 3 shall each have an unexclusive easement
of ingress and egress over Parcel Y as shown on a plat of record in
the Clerk's office of the Circuit Court of Albemarle County,
Virginia, in Deed Book 1436, page 481, and over the "Travelway and
Parking Easement" as shown on the attached plat, together with the
exclusive use of designated parking hereafter set out and the
unexclusive use of the other parking areas, The approved site plan
allocates a total of 16 parking spaces for Lot 1 of which 8 shall
be designated for its exclusive use and a total of 11 parking
spaces for Lot 2 of which 6 shall be designated for its exclusive
use. Forest Lakes Associates reserves the right to designate as
reserved parking for Lot 3 parking spaces on Lot 3 up to but not
exceeding 50% of the required parking by Albemarle County for the

use occurring on Lot 3. It is understood and agreed that the
parking spaces on Lot 3 within the hatched area designated as
Area A" on the attached plat will be built in whole or in part
only at the option of Forest Lakes Associates once it determines in
it sole discretion if they are needed. Lots 1 and 2 are granted an
easement over the crosshatched area only to the extent that parking
spaces are built in the future and when built Forest Lakes
Associates shall record a plat showing the area on Lot 3 actually
designated for parking.
3. Lots 1, 2 and 3 are responsible for the maintenance
(including snow removal), repair, and replacement of the access
lanes/driveways and the parking areas. The cost for these items
will be shared by the lots as follows: Lot 1: shall pay 32% of the
cost; Lot 2: shall pay 21k of the cost; Lot 3: shall pay 47% of the
cost. No Lot shall be responsible to contribute to the maintenance
until such time as a building permit is issued for the Lot. As
long as only one lot has a building permit issued, it shall pay all
the costs until the second lot has a permit issued. When two lots
have their building permits, they shall each contribute in the same
relative proportion as set forth above until the third lot has
obtained its permit. The access lanes/driveways and parking areas
shall be kept in good repair at all times and work will be done
when any two of the three lots so agree. If during construction on
its Lot, any owner of a Lot causes damage during construction to
the access lanes/driveways and parking areas, it shall solely be
responsible for the cost of repair. The County of Albemarle-2and

the Virginia De artment of Transportation shall have no
responsibility for maintenance of the access lanes/driveways and
parking areas unless it is publicly dedicated and acce ted hy the
Count or by the State road s stem.
4. Recorded in the Clerk's Office of Albemarle County in
Deed Book 1463, page 477, is a document imposing upon Lot C (which
is now subdivided into Lots 1, 2 and 3 on the attached plat)
certain assessments for Parcel Y and for a drainage pond. The cost
imposed on Parcel C are to be shared among Lots 1, 2 and 3 in the
same percentages as set forth in Paragraph 2 above.
5. The payment of any sums due from the owners of Lots 1, 2
and 3 under Paragraphs 2 and 3 shall be paid by each owner within
30 days of receipt of any bill or statement. if any owner must
bring suit to enforce this agreement or recover any costs advanced,
the losing party shall also owe the costs associated with the suit,
including reasonable attorney fees of the prevailing party.
6. The document recorded in the Clerk's Office of the
Circuit Court of Albemarle County, Virginia in Deed Book 1463, page
477 provides that Forest Lakes in the future may elect to convey
the fee simple title of Parcel Y with one --half to Lot D and one-
half to C. The one-half passing to Lot C shall be added to and
become part of Lots 1 and 3 as shown on the attached plat.

assigns easements in such locations as do not interfere with the
building site on each Lot for utilities, drainage and any other

8. Lot 1 has as an appurtenance to it a "10' Private Sewer
Easement" across Lot 2 as shown on the attached plat for the
installation, repair and replacement of a sewer line connecting Lot
I to the Albemarle County Service Authority public line. The cost
of the maintenance, repair and replacement of this sewer line is
the sole responsibility of Lot 1. Lot 2 has as an appurtenance to
it a "I0' Private Waterline Easement" across Lot 1 as shown on the
attached plat for the installation, repair and replacement of a
water line connecting Lot 2 to the Albemarle County Service
Authority public line. The cost of maintenance, repair and
replacement of this water line is the sole responsibility of Lot 2.
Each lot is responsible for returning any area disturbed by
maintenance, repair or replacement to its prior existing condition.
The name of Frank A. Kessler, General Partner of Forest Lakes
Associates, has been signed hereto by Stephen N. Runkle, as
attorney in fact under Power of Attorney dated December 18, 1989,
recorded in the aforesaid Clerk's Office in Deed Book 1082, page
560.
