This will include the following; ❑ The last instrument of record in the Clerk's Office of the Circuit Court of Albemarle County, Virginia on or prior to December 10, 1980. ❑ Include deeds that provide a plat or metes and bounds description of the property. (Highlight or underline references to the subject property). ❑ All plats and deeds of record after December 10, 19809 UP UNTIL THE PRESENT DATE. (Highlight or underline references to the subject property). Cover letter stating the assumed number of parcels and development rights, with explanation of same. Any other pertinent information. We ask for this official letter for the following reason: Rio Commons, LLC, has contracted to purchase from the Charlottesville Waldorf School a 2.5 Acre portion of the school's property described as TM 61-parcel 17, sketch attached. Concurrent with this application, Rio Commons will be submitting a boundary line adjustment to add the 2.5 acres to Rio Commons' adjacent property with the intent of preparing a development plan for the combined sites. While the Waldorf School property is zoned R4 we are asking the Zoning Department to clarify the number of development rights associated with the 2.5 acres, which we assume are 10, not including possible bonus densities. Further, we ask that you please clarify that these development rights will transfer to Rio Commons with a completed sale. Note that the 2.5 acre site in question is currently a portion of the Waldorf School property developed under an SP. The land use plan approved for the Waldorf School calls for this 2.5 acres to be "open space". Rio Common's intent and contractual commitment to the Waldorf School is to maintain the 2.5 acres as open space, but we do intend to utilize the site's development rights as part of the development plan to be executed on the 4.37 acres of land already owned by Rio Commons.
