Dear Francis,
Pursuant to the attached application for an Official Letter of Determination the following is an explanation justifying
my request.
Current Zoning Rural Areas
Tax Map 93, Parcel 24 was zoned to Rural Areas (RA) on December 10, 1980. It's my opinion that action established
Five (5) Developments Rights per existing real property parcels.
Original Legal Description
The legal description for the Lots 1 and 2 were created by plat recorded January 9, 1909, found recorded in the
Clerk's Office of the Circuit Court of Albemarle County, Virginia in Deed Book 139, Page 33. Therefore they each
would contain 5 development rights.
Current Owner
The current owner of the remainder of Lots 1 and 2 ( Tax Map 93, Parcel 24) is Joan C. Meredith, and were conveyed
by deed of gift dated March 31, 1980 found recorded in the Clerk's Office of the Circuit Court of Albemarle County,
Virginia in Deed Book 703, Page 534.
Off Conveyances
1. A portion of Lot 1 containing 0.55 Ac. (TMP 93-24A) recorded in Deed Book 322, Page 597.
2. Portions of Lots 1 & 2 for Rt. 53 R.O.W., Commonwealth of Virginia recorded in Deed Book 245, Page 139
3. Portions of Lots 1 & 2 containing 5.00 Ac., (TMP 93A-24B), recorded in Deed Book 711-556, 557 Plat.
I have found no record for Lots 1 and 2 being combined other than as shown on real estate tax maps.

right, 50 feet to Sta. 90+65, the point of digression.
The land conveyed hereunder being a strip or parcel of
varying width, lying on the North (left) side of the hereinabove described
centerline, being 0.0 feet wide at a point 25 feet opposite Station 90+15
thence ridening with the lands of Floyd Cash to 15 feet at a point 10 feet
opposite Sta. 90+32; thence narrowing with the centerline of present road
to n.0 feet at a point 25 feet opposite Sta. 90+65.
Said strip or parcel oontains 0.009 acre, more or less,
of which 0.005 acre is included in the present right of way and 0.004 acre,
more or less, additional land.
The said grantor covenants that he has the right to
convey the said land to the grantee; that he has done no act to encumber the
