This project is denied for reasons listed below. The VSMP application content requirements can be found in County Code section 17-401. A. Stormwater Pollution Prevention Plan (SWPPP) (Rev. 1) Addressed. The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. 1. Sec. 4, 5: Update these sections with revised ESC and SWM plan sheets, once comments are addressed. Sec. 6.A. / Exhibit: While ESC /SWM plans are at Sec. 4, 5, please include PPP Exhibit (sheet C-3 can serve as a basis). On Exhibit, please show: i. Rain gauge location ii. Concrete washout location iii. Solid waste dumpster location iv. Solvent /chemical storage location v. Paved construction entrance (PCE), with spray wash vi. PCE spray wash collection trapping measure vii. On -site fuel storage location, if any viii. Portable sanitary facility location 3. Sec. 9., Signed Certification: Individual who prepared SWPPP document must sign as condition of VSMP /WPO plan approval. Also, Albemarle cannot register project with DEQ until SWPPP Sec. 9 is complete. 4. Include 2019 Notice of Termination form. Revise SWPPP booklet title to include ref. to VSMP /WP02020-00016. B. Pollution Prevention Plan (PPP) — See above. (Rev. 1) Addressed. The PPP content requirements can be found in County Code section 17-404. C. Stormwater Management Plan (SWMP) —Also, please see SDP202000024 Engineering review comments d. 15-Apr 2020. Note: Item 4, below, is copied verbatim from SDP202000024 (4/15/20) Engineering final site plan review comments. Given this, overlap between ESC and SWM plan -related (and even site plan) comments is possible. Engineering Review Comments Page 2 of 6 VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This plan is approved pending recordation of a new filterra SWM facility easement; see items 2.b., 4.h., and 6, below. The stormwater management plan content requirements can be found in County Code section 17- 403. 1. Easement Plat (C1 Note 3): Plat at deed bk.-pg. 4489-22 includes label reading: `* Easement is defined with this plat but will be created and dedicated with a separate instrument.' Furnish deed bk. -pg. ref. to recorded instrument that creates and dedicates north underground detention (at Costco) to public use (Albemarle County, Grantee). (Rev. 1) Addressed. 2. Easement Plat (C_1 Note 4): Certificate of Plat at deed bk.-pg. 4135-217 is insufficient for WPO202000016 plan approval (WPO2011-00055 Amendment). Certificate of Plat, sheet 1 of 8, plat Note 8, may offer clue. This note reads: `A Master Declaration will be prepared and recorded in conjunction with this plat. Please see this Declaration for common shared rights and easements of all owners of these parcels.' Since document at bk.-pg. 4135-215 is only a Certificate of Plat, please revise C=1 second Note 3 to include text reference to a Certificate of Plat, rather than a Maintenance Agreement. Also: a. Revise second note 3 to read Note 4. (Rev. 1) Addressed. b. Provide bk.-pg. ref. to SWM Facility Maintenance Agreement for District Ave. biofilter. (Rev. 1) Comment revised. As follow-up: A Maintenance Agreement to reference WPO202000016 is required for on -site filterra unless an executed maintenance agreement with Albemarle Co. exists. c. Provide bk.-pg. ref. to SWM Facility Easement for District Ave. biofilter*. (Rev. 1) Addressed. (* This SWM facility easement may be included with Master Declaration referenced in Plat, sheet 1, Note 8, but Certificate of Plat only states that a Master Declaration will be prepared, and does not provide bk.-pg. ref. to recorded Master Declaration, or to a SWM (biofilter) easement.) 3. C1: Beneath plan title text reading Amendment to WPO2011-00055, please provide new text reading VSMP IWPO202000016. (Rev. 1) Addressed. 4. below SDP202000024 Engineering final site plan review comments, 15-Apr 2020 For Final Site Plan Approval: (FSP) Partially addressed /see below. WPO202000016 review is pending. Submit VSMP Amendment Plan to WPO2011-00055. Although WPO2011-00055 is approved, site layout has changed. WW Associates prepared WPO2011-00055 /SDP2011-00047, so plan sheets and design data are likely readily available. At a minimum, please include the following with WPO Plan Amendment: a. (LOD) Limits of Disturbance. Ref. SDP C-15, DA Parking Area: Project Area =3.01 Ac. (FSP) Comment persists. As follow-up, revise WPO C-3 to include label /leader line indicating 2.66 Ac. disturbance. (Rev. 1) Addressed. b. Since claiming this is a grandfathered project, ref. /address conditions required for Grandfathering to guide review and approval, including 9VAC25-870-48.A. L(iv): `...has not been subsequently modified or amended in a manner resulting in an increase in the amount of phosphorus leaving each point of discharge, and such that there is no increase in the volume or rate of runoff.' This means if apartment development runoff exceeds parking lot runoff, then on -site preliminary and modest detention may be required prior to discharge to overall Albemarle Place detention system installed beneath Costco parking lot. Design should provide and review will consider: points of discharge, amount /rates of storm release from D 1, especially whether apartment development increases overall site imperviousness even slightly, which it appears may be the case. Please ref. 9VAC25-870-48, as well as SDP2011-00047, sheets C-15, -16 (Storm Sewer Design comps), etc. (FSP) Comment revised to request that WPO202000016 confirm any increase in rate of runoff or amount of phosphorus leaving SWM detention facility beneath Costco parking lot (easement shown on bk.-pg. 4135-223). (Rev. 1) Addressed. Applicant response (WW Assoc. letter, 5/21/20): `The North UGD detention system was designed utilizing a 90% impervious cover for Block D1 based on the ultimate buildout condition. The impervious cover for the proposed development is 83.4%. Therefore, the rate of discharge from the North UGD system is decreased with this development. The North UGD Stormfilter and Vortechs units provide a higher phosphorous removal rate than required. Please note the calculations indicate that the amount of phosphorous leaving the site has increased slightly from the approved analysis provided with Engineering Review Comments Page 3 of 6 WP02011-00055. This is due to the use of the higher re -development removal rate being utilized on the Simple Method Worksheet versus the new development removal rate that was used for the construction of the existing parking lot.' c. Revised storm sewer design computations. Also, see item 7., below. (FSP) Partially addressed. As follow-up: see item 24, below. (Rev. 1) Persists at SDP2020-00024, Engineering review item 24. [Item 24: `Storm profile 46 thru 46.8 shows 18" HDPE downstream of 24" DIA pipe. Increase receiving pipe diameter.' Note: Include storm profiles (not at present included) with WP02011- 00055 Amendment /WP0202000016 since post -developed As -built drawing (relocated filterra) also needs to include storm lines built with apartment project. Also, SWM Plan item 5, below.] d. ESC Plan: show tree protection (TP) for trees that are to remain. (FSP) Addressed /shown on WP0202000016 C-3. e. SDP2011-00047, C-18 includes typ. ESC measure details required during parking lot construction. Provide ESC measures appropriate for parking lot demolition, and apartment construction. These may consist of IP, RWD, TS, SAF, etc. but prior -approved WPO does not consider current development, only past development. ESC plan is required with WP02011-00055 Amendment. (FSP) Addressed. Maintenance for the facilities are addressed within sections 7.2.3 and 9.2.2 of the master declaration for Stonefield. A copy of the master declaration is provided with this submittal as requested by Planning.' SDP2011-00047, C-23]), including ref. to approved WPOs, to prepare a comprehensive standalone Amendment to WPO2011-00055. (FSP) Comment persists. For example: WPO202000016, C7, Stormwater Narrative relies on biofilter `installed as part of the Stonefield Blvd Road Plan (WPO201100036).' WPO2011-00036 (C-22) shows a biofilter at present-day Int. of District and Houston. Please provide an As -built drawing comparing as -built condition of this biofilter against design (WPO201100036, C-22). Note: WPO201100036, C-22, calculations provide that load removed by biofilter (C-22) = 5.26 X 0.65=3.42lbs. If later WPO or WPO Amendment revised biofilter design to provide WPO202000016 C7 pollutant removal of 9.69 lb, reference WPO# on SDP202000024 and WPO202000016. Also, please revise WPO202000016 C7 text /calculations (Narrative), consistent with as -built condition of Houston - District biofilter, and approved SDP /WPOs, including biofilter landscaping (as -built v. design). (Rev. 1) Addressed. Applicant: `An analysis of the District Ave. biofilter confirms that it was constructed in accordance with the Amendment to the Stonefield Blvd Road Plans WP02011- 00036 dated 3/12/12. The surface area of the constructed biofilter is approximately 4,493 sq.ft. and 4,437 sq.ft. is required. The as -built survey for District Ave. indicates that the biofilter plantings were installed in accordance with the approved plans. The 3.421b removal rate shown on the Stonefield Blvd Road Plans WPO2011-00036 was only for the drainage areas directly associated with the road plans and did not include D1. The BMP calculations for D1 are provided separately on the CI -IV Final Site Plans WPO2011-00055. (Rev. 1) Addressed. Engineering Review Comments Page 5 of 6 6. Easement deeds and District Ave. biofilter SWM Facility Maintenance Agreement must be recorded prior to VSMP /WPO2020-00016 approval. (Rev. 1) Comment persists. Also, item 4.h., above. D. Erosion and Sediment Control Plan (ESOP) Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESOP. This plan is disapproved for reasons listed at item 3, below. The erosion control plan content requirements can be found in County Code section 17-402. 1. C2: Provide reference to 2.66 Ac. area of disturbance. Also, item 4.a., above. (Rev. 1) Addressed. 2. CC3: Remove /replace this plan sheet. Provide a Phase 1 ESC plan based upon existing conditions, that includes demolition. Ex. condition is paved lot. Ref. 3/19/18 Pictometry2 imagery, below. At a minimum, provide: (Rev. 1) Addressed. Applicant: `The plan sheet showing the paved parking lot has been added showing the requested information. A stockpile is not anticipated during this phase of construction. Inn addition, it is anticipated that the safety fence will be temporary chain link fencing and will not be embedded into the pavement' a. Existing land cover (pavement). b. Existing grade: generally flat, since paved. c. Inlet protection during demolition of existing pavement. d. Sequence of demolition should a portion of Ex. pavement serve as a stockpile /storage area. e. Paved construction entrance symbol, PCE, on plan (detail shown on C6). Construction vehicles may not exit onto Inglewood via a stone construction entrance. Show /label spray wash. f. PCE spray wash collection /small trapping measure. Also, see PPP Exhibit. g. If PCE is gated into the site, show and label gate. j. * It is vital for incident -free compliance to work from Ex. conditions, to match ESC perimeter controls to existing conditions /demolition, and to consider staged vertical construction of the apartment complex. [ image removed with Rev. 1 comments] 3. C=4: Remove contractor laydown /storage that overlaps improvements at entrance on Houston. An interim - phase ESC plan may be required to advance site work /vertical construction. Main entrance to apartments on Houston could serve as laydown /storage while portion of site is developed. At some point, it appears an offsite laydown /storage area may be required. This off -site area must be identified /reported to CDD prior to project receiving a grading permit, or sequence demonstration made that an off -site area is not required even as construction of a building that occupies nearly the entire site advances. Note: The Standard (Main Street, Charlottesville) required long-term closure of a travel lane of Main St. (Rev. 1) Persists. Applicant: `The contractor laydown/storage area has been removed as requested. The use of off - site areas or any temporary lane closures required for the building construction is at the Contractor's discretion and falls within means and methods. The Contractor shall update the SWPPP as required during construction to address site conditions as they are revised from that shown on the plans.' As follow-up: Comment accurately states any off -site areas must be identified /reported to CDD prior to project receiving a grading permit if an off -site area is known with a degree of certainty prior to preconstruction conference. A contractor is not at liberty to disturb off -site areas >10,000 sq.ft. absent coordination with Engineering. A means and methods exemption from VSMP requirements that may apply to an offsite laydown /storage area within Albemarle County does not exist, per se; only area of disturbance exemptions exist. Contractor is expected to notify Engineering at any point during construction of any off -site activity that may involve land disturbance. Please add notes to plan to convey this meaning. 4. Additional comments possible Engineering Review Comments Page 6 of 6 The VSMP permit application and all plans may be resubmitted for approval when all comments have been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package with a completed application form. Feview. Video or teleconference is available for review comment discussion; covid-19 pandemic has altered past practices. Process: After approval, plans will have to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel and easement information based on the approved plans. The County's Management Analyst will prepare bond agreement forms, which will have to be completed by the owner and submitted along with cash, certificates or sureties for the amounts specified. The agreements will have to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms. Stormwater Management Facilities Maintenance agreements will also have to be completed and recorded. The County's Management Analyst or other staff will prepare the forms and check for ownership and signature information. The completed forms will have to be submitted along with court recording fees. After bonding and agreements are complete, county staff will enter project information in a DEQ database for state application processing. DEQ will review the application information based on local VSMP authority approval. At this time, the DEQ portion of the application fees will have to be paid directly to the state. For fastest processing, this is done electronically with the emails provided on the application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the application, they will issue a permit coverage letter. This should be copied to the county. After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference. Applicants must complete the request for a pre -construction conference form, and pay the remainder of the application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At the pre -construction conference, should everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that work may begin.
