RE: SUB202000069 Eastern Avenue Right of Way & Easements — Boundary Line Adjustment
Dear Mr. Langille,
The plat has been revised to address your comments received on May 8, 2020 in accordance with the
following:
[General Comment] There are two dashed lines running north/south located near the proposed 10'
private trail easement that are not labeled and do not appear to represent property lines or existing
easement boundaries. Please verify what those lines are supposed to represent. These two lines are
located near line segments L8 and L9.\
RESPONSE — Lines represent an existing SWM Access & Maintenance Easement; lines are now
clearly labeled.
2. [General Comment] Note numbers repeat. There are two notes 5-8. Please revise.
RESPONSE — Numbers corrected.
[14-302 (A)(3)] In the street label, please state the deed book and page number of the recorded
instrument that dedicated the existing portion of Eastern Avenue that is visible on this plat.
RESPONSE — Deed book and page added to note.
4. [14-302 (A)(4) and 14-302 (A)(5)] It appears that the proposed 20' drainage easement, a portion of the
variable width private trail easement, the 10' wide private trail easement, and the new 20' ACSA
sanitary sewer easement are going to be located on TMP 056KO-00-04-OOOAO, not TMP 056KO-00-00-
000A2. Please address the following:
a. [14-302 (A)(1)] State TMP 056KO-00-04-000AO in the subdivision title.
RESPONSE — Updated title.
b. [14-302 (A)(4)] Please indicate who will own and maintain the proposed variable width private
trail easement and the 10' trail easement and provide the instrument number that is stated as XXX
in the first note #8.
RESPONSE — Updated note in reference to the Pedestrian Tunnel Agreement, see note #10.
c. [14-302 (A)(4) and 14-302 (A)(5)] Please indicate in the easement label whether the new 20'
drainage easement will be public or private. A deed may be required for this easement.
RESPONSE — Updated label.
d. [14-302 (A)(11)] State the instrument that created TMP 056KO-00-04-000AO in a note.
RESPONSE — Shown in the Statement of Title block.
e. [14-302 (A)(15)] State the owner name and addresses of each owner of record and the holders of
any easements on TMP 056KO-00-04-OOOAO.
RESPONSE — Shown in the Statement of Title block as well as the Statement of Consent to
Division block.
£ [14-302 (B)(5)] State the zoning classification and all applicable overlay zoning districts of TMP
056KO-00-04-000AO in a note.
RESPONSE — Updated notes to include all affected TMPs.
g. [14-302 (13)(7)] Add a note stating whether TMP 056KO-00-04-000AO is within an Albemarle
County and/or City of Charlottesville water supply watershed or an agricultural -forestal district.

h. [14-303] Add a statement of consent to division for TMP 056KO-00-04-OOOAO.
RESPONSE — Added a Statement of Consent for all affected TMPs.
i. [14-303 (C)] Clearly show the property lines of TMP 056KO-00-04-OOOAO.
RESPONSE — Labeled and highlighted property lines of adjoining affected TMPs.
j. [14-303 (0)] Add a signature panel for the property owners of TMP 056KO-00-04-OOOAO.

5. [14-302 (13)(1)] Please add a date of last revision.

6. [14-302 (13)(5)] Please revise notes 8-12 as follows:
a. Consolidate these notes into a single note.

b. State the correct TMP number, TMP 056KO-00-00-OOOA2.
RESPONSE — Corrected TMP numbers.
c. Mentioning setbacks is not required for BLA plats, so do not include the text from Note 9 that
mentions setbacks.
RESPONSE — Removed setback notes.
7. [14-303 (H)] Please show and identify the location and material of all permanent reference monuments.
Monuments found or installed prior to plat recordation may be referred to if they are permanent and
undisturbed. If any monument required by this chapter will be installed after recordation of the final
plat, the certification of the professional engineer or land surveyor shall so note.
RESPONSE — Updated monuments found to show on survey, note 2 states all new property
corners shall be monumented with iron rods unless otherwise noted.
8. [14-303 (L) and 14-421 ] It appears that the shaded area that is being vacated represents an existing
easement? Please state the deed book and page number of the recorded instrument that created that
easement.
RESPONSE — Shaded area more clearly labeled with record information.
9. [14-428] Please revise the callout for the Eastern Avenue right-of-way dedication. It should state
"0.987 Parcel X Variable Width Public Right -of -Way Hereby Dedication to Albemarle County for
Public Use."
RESPONSE — Updated callout.
Albemarle County Transportation Planning
No objection.
Albemarle County Engineering Division (May 18, 2020)
1. Show the Public Drainage Easement for the stream crossing culvert.
RESPONSE — Added New Public Drainage Easement.
2. Label the New 20' Drainage Easement as public.
RESPONSE — Updated label.
A deed will be required for the new public drainage easements. This will be filled out by the County
and forwarded to the applicant as the plat is nearing completion.
RESPONSE — Attached to resubmittal.
Albemarle County Department of Parks & Recreation (May 28, 2020)
1. Update note 8 to show deed book and page of recorded ped tunnel agreement.
RESPONSE — Updated note, see note #10.
Albemarle County Service Authority
RGA shall show the existing sanitary sewer easement through the proposed R/W and label it to be
vacated.
RESPONSE — Show full extent of existing sanitary sewer easement, labeled vacated.
2. Need developer to submit as-builts to ensure no additional easements are required for the waterline.
RESPONSE — Submitted under different cover.
Virginia Department of Transportation (May 26, 2020)
Please show the drainage easement for the stream as shown on the road & site plans.
