HomeMy WebLinkAboutSUB202000072 Review Comments Family Division Plat 2020-06-10°r Aj�� r m :rr County of Albemarle Department of Community Development Memorandum To: David Jordan, Commonwealth Land Surveying From: Tori Kanellopoulos — Senior Planner Division: Planning Services Date: June 10, 2020 REV 1 Subject: SUB202000072 — TMP 93-11 — Family Subdivision The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. New comment based on new changes from first submittal: [14-302(B)(6)] Tax Map Parcels. Revise all Tax Map Parcel labels to read either "TMP" or "Tax Map Parcel", instead of "PID". 2. New comment based on new changes from first submittal: [14-303(C)] Boundary lines. Several boundary line dimensions for TMP 93-11 have been removed between submittals. Please include all boundary dimensions for both TMP 93-11 and Lot 1. 3. New comment based on new changes from first submittal: [14-303(A)] Statement of consent to division. Revise the Owners Approval note to meet the following requirement: "The platting or dedication of the following described land [insert a correct description of the land subdivided] is with the free consent and in accordance with the desire of the undersigned owners, proprietors and trustees, if any." a. Additionally, each owner should have a separate signature block per 14-303(0) with the statement included for each signature block. 4. New comment based on new changes from first submittal: Remove note in County signature block ("The Platting or Dedication... If Any"). There should not be a note associated with the County's signature. 5. _.._-t 2, include 'SR 762' under `to Rose Hill Church Lane', to be clear that this connects to a public ROW. a. REV 1: Addressed. 6. [14-302(A)(3)] and [14-403] Streets and frontage. Frontage is required for the new Lot 1. There are two options for frontage: a. Either: Provide the plat/recordation showing that the `existing road' is an existing private street approved by the County. See attached correspondence referencing DB 84 PG 373. If this is an existing private street, label it as `existing private street' and include the DB/PG creating the private street on the plat. b. Or: Label as `new private street' and extend the private street from new Lot 1 to the public ROW (SR 762). In this case, the owner of TMP 93-12 will also need to sign the plat. c. REV 1: Partially addressed. A new private street has been provided, as have signature blocks for both owners. The private street should not be shown on TMP 92-23's property unless that owner is also signing. d. REV 1: Given that this is a new private street, the following statement is required per 14-412(A)(4): "The existing and/or proposed right-of-way is of adequate width and horizontal and vertical alignment to accommodate a travelway passable by ordinary passenger vehicles in all but temporary extreme weather conditions, together with area adequate for maintenance of the travelway, as required by section 14-412 of the Albemarle County Code." 7. [1 4-302(A)(1 0)] Development rights. Revise the development rights notes to include the following: "The residue of Tax Map Parcel 93-11 is retaining four (4) development rights and may be further divided." a. REV 1: Partially Addressed. Please use "TMP" or "Tax Map Parcel", instead of "PID". 8. [14-302(A)(11)] Instrument that created the property. Include the deed book and page number of the instrument whereby the property was created (not just the most recent instrument). a. REV 1: Addressed. 9. [14-302(B)(8)] Setbacks. Revise and include the correct setbacks for the RA zoning district. a. REV 1: Addressed. 10. [14-302(B)(10)] Stream buffers. Show/label the stream buffer on the plat and include the required note to meet the following requirement: The location of stream buffers required by the water protection ordinance, with the following note: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." a. REV 1: Addressed. 11. [14-312] Location of existing buildings. Show the location of the existing dwelling unit on TMP 93-11. a. REV 1: Partially addressed. Revise label to "Approximate Location Building per County GIS", not building buffer. 12. [14-309] and [14-310] Health Director Approval. Approval from the Health Director is required for this application. The necessary information has been transmitted to the Health Director and is under their review. a. REV 1: VDH review is in progress. 13. [14-� ICJ , G,,,,,y ou"UIV10.i.,o, , approval. The family declaration is still needed for review. County Attorneys Office review and approval is required for the family division declaration and affidavit. a. REV 1: Addressed. 14. [14-212(B)] Family subdivisions; conditions of approval. In order to add the requested daughter-in-law to the family division, a letter from a lending institution is required. Please see attached template. a. REV 1: Addressed. 15. [Comment] Private street maintenance agreement (recommended). While private street maintenance agreements are not required for family subdivisions, the County does recommend them. It can facilitate future real estate transactions to have the agreement officially recorded. Please let staff know if you wish to be sent the template to complete. a.
