THIS DEED made this 1st day of April* 1967, by and
between Helen Cunningham and Alice Cunningham, both unmarried,
parties of the first part, and Aaron S. Schwartzman and Beatrice
H. Schwartzman, husband and wife, parties of the second part,
W I T N E S S E T H:
That for and in consideration of the sum of $205,000.00,
of which $76,730.38 is cash in hand paid, receipt of which is
hereby acknowledged, and $128,269.62 is paid by the assumption by
the parties of the second port of the deed of trust hereinafter
described, said parties of the first part hereby grant, bargain
and sell and convey WITH GENERAL WARRANTY OF TITLE unto said
parties of the second part as tenants by the entirety with full
right of survivorship as at common law and not as tenants in
common; all that certain tract or parcel of land situated in Alba-
marle,County, Virginia, in the vicinity of Cismont, containing
326.46 acres, more or less, shown on composite plat of William S.
Roudabush, Jr., C.L. S., dated January 1967, which plat is hereto
attached as a part of this deed. Said property hereby conveyed
is composed of seven adjoining parcels of land which were conveyed
to the parties of the first part by deedsas follows:
(1) 165.7 acres by deed of Henry S. Cunningham and
wife, dated Jane 25, 1941, recorded in the Clerk's office
of the Circuit Court of Albemarle County in Deed Book 250,
page 594. Said tract of 165.7 acres is shown on plat re-
corded in said Clerk's Office in Deed Book 196, page 106;
(2) 44.56 acres by deed of T. M. Boyd, Special Com-
missioner, dated November 11, 1936, recorded in said Clerk's
Office in Deed Book 233, page 492. Said tract of 44.56
acres is shown on plat recorded in said Clerk's Office in
Deed Book 151, page 282.

(3) 22.9 acres by deed of Henry S. Cunningham and wife,
dated July 9, 1951, recorded in said Clerk's Office in Deed
Book 296, page 375. Said tract of 22.9 acres is shown on pla
rrecorded.D.B.296,p.377 and is composed of a tract of 17.85
acres and a tract of 4.9 acres. Upon examination of title
it was found that there was still outstanding in other per-
sons a three -fifths interest in said tract of 17.85 acres
which, however, has now vested in said parties of the first
part by virtue of a decry a of the Circuit Court of Albemarle

County entered on the /, 7' day of �� <• 1967 and spread
in said Clerk's Office in Deed Book page 4/62-
(4) 26 acres by deed of Bartlett Bolling, Jr. and wife,
dated November 15, 1938, recorded in said Clerk's Office in
Deed Book 241, page 520;
(5) 29.70 acres by deed of David S. skinner and wife,
dated July 26, 1939, recorded in said Clerk's Office in Deed
Book 243, page 557;
(6) 16.94 acres by deed of Charles H. Hughes and wife,
dated June 23, 1949, recorded in said Clerk's Office in Deed
Book 284, page 337;
(7) 20.91 acres by deed of B. C. Spence and wife,
dated August 14, 1946, recorded in said Clerk's Office in
Deed Book 269, page 532.
Said tracts of 26 acres, 29.70 acres, 16.94 acres and
20.91 acres form together a tract of 93.3 acres which is
shown on plat recorded in said Clerk's Office in Deed Book
291, page 64.
Reference is here made to the aforesaid deeds and pla
for a more particular description of the property hereby conveyed.
The property hereby conveyed is subject to an easement
for a pole line granted to Virginia Public Service Company by deed
dated October 22, 1938, recorded in said Clerk's Office in Deed
Book 242, page 100, a pole line right of way granted to Virginia
Electric and Power Company by deed dated November 6, 1951, record-
ed in Deed Book 299, page 100, a pole line easement granted Vir-
ginia Electric and Power Company by deed dated November 12, 1954,
recorded in Deed Book 314, page 576, a pole line right of way
granted Virginia Electric and Power Company by deed dated March
18, 1963, recorded in Deed Book 387, page 164, and pole line right
of way granted Virginia Telephone and Telegraph Company by deed
dated December 10, 1964 recorded in said Clerk's Office in Deed
Book 403, page 518.
Subject to the aforesaid easements said parties of the
first part covenant, that they are seised in fee simple of the
land hereby conveyed and have good right to convey the same; that
they have done no act to encumber said land; that the parties of
the second part shall have quiet possession of said land free fro
all encumbrances, and that they, the parties of the first part,

will execute such other and further assurances thereof -as may be
requisite.
And said parties of the second part as evidenced by
their acceptance of this deed assume the payment of a debt of
$128,269, originally $130,000, secured by deed of trust from said
parties of the first part to Joseph W. Richmond and S. N. Karicofe
Trustees, dated May 25, 1965, recorded in said Clerk's Office in
Deed Book 407, page 351, and the interest thereon,from December
16, 1966 and they hereby covenant and agree to comply with the
terms and provisions of said deed of trust and to save the parties
of the first part harmless therefrom.
