County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below. The application may be resubmitted for approval if all
of the items below are satisfactorily addressed. The VSMP application content requirements can
be found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESOP, (3) a SWMP, and (4) any TMDL measures necessary.
1. This SWPPP book must be updated with the approved plan sheets at time of approval. Rev. 1:

2. Rev. 1: Please ensure the correct names are on section IA and VI. It is unclear if they are
the same. Rev. 2: Please verify the person who signed section VI meets the signatory
requirements for the operator.
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. What is the star hatching for? It is unclear in the legend. (forest & open space, correct?) Rev. 1:

2. EC-2 matting is shown in the legend, but it is not clear where it is to be used on the plan.(appears
to be a scaling issue) Rev. 1: Comment addressed.
3. Ensure all PPP items are shown on the plan (stockpile, staging area, etc.) Rev. 1: Comment

C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The

stormwater management plan content requirements can be found in County Code section 17-403.
1. The dedicated open space must be in an easement and should be labeled SWM Forest & Open
Space. The following note should be on the plan and plat, "The SWM Forest and Open Space
Easement is subject to the guidance set forth by DEQ in the Virginia Stormwater Management
Program. The areas will remain undisturbed in a natural, vegetated state, except for activities as
approved by the local program authority, such as forest management, control of invasive species,
replanting and revegetating, passive recreation (e.g., trails), and limited bush hogging to maintain
desired vegetative community (but no more than four times a year) " R ov 1 • Cnmmont 2ddrecaed
2. The forest and open space easement must be recorded before plan can be approved. Rev. 1:

3. SWM maintenance agreement must be recorded before plan approval. Please contact Ana
Kilmer (akilmer(&albemarle.org or 434-296-5832 ext 3246) to begin this process. Rev. 1:
Comment not addressed. Rev. 2: Agreement is prepared, just needs to be signed and
returned to the county to be executed.
4. Please clarify calculations, for example, there are 4 POAs in hydrocad output, but there are 3 in
the plans. It appears DA 2 & 3 go to POA 2 (LS #1). Please ensure the calculations match this.

5. Please provide culvert design information. Ditch calculations were provided, but not culvert
calculations. Rev. 1: Comment addressed.
6. [Sheet C3] There appears to be work in the VDOT right-of-way. Has this been approved by
VDOT? Rev. 1: Construction cannot begin until appropriate VDOT permit is acquired.
Rev. 2: Comment acknowledged.
7. [Cover Sheet] Provide date topographic information was acquired. Source was listed, but no date.
Rev. 1: Comment addressed.
8. [Sheet C3] Consider making slope on the NW side of driveway 3: 1, not 2: 1. Otherwise, special
plantings that can withstand that slope must be specified. Rev. 1: Comment addressed.
9. [Sheet C4] There appears to be an error in the level spreader detail and table. Dimension should
be 3ft, not 3 inches. Also, length should be 36, not 35 ft. Rev. 1: Comment addressed.
10. [Sheet C4] Drainage area to level spreaders does not appear to be correct. From calculations
booklet, DA 2 & 3 appear to go to LD #1 (5.49AC), and DA 4 to LS#2(3.45AC). Or, if following
the ditch drainage areas, LS #1 should have 1.09 AC, not 0.14 AC. Rev. 1: Drainage areas have
been clarified, however, the design DA for the level spreaders(on Sheet C4) does not appear
to be correct. LS # 1 should be 5.5 AC and LS #2 should be 3.45 AC based on Page 17 in the
SWM booklet (post -development drainage areas).Rev. 2: Why does LD#1 have more area
and flow, but is shorter in length?
11. Rev. 2: The level spreaders are not scaling to length on sheet C3. LS#1 is scaling 14 ft and
LS#2 is scaling 22 ft.
12. Rev. 2: Please correct the ditch detail on sheet C4. It appears some descriptions are left off
the chart/table. It just says channel, not length, width, slope.
13. Rev. 2: On sheet C5, please label the area, SWM forest & open space easement. Ensure it is
labeled this way on the plat as well.
D. Erosion and Sediment Control Plan (ESOP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is approved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.

1. Please provide the paved CE w/ WR detail from the design standards manual. Rev. 1: Comment
addressed.
2. Provide silt fence for perimeter controls adjacent to the road. Rev. 1: Comment addressed.
3. Provide controls for the culvert at the driveway entrance. Rev. 1: Please clearly specify the
details for outlet protection (sizing, dimensions, etc). Rev. 2: Comment addressed.
4. The driveway culvert that outlets into ditch 1 should have outlet protection, not inlet protection.

5. Provide a location for a stockpile area as well as a construction staging area. Rev. 1: Comment
addressed.
The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process:
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond
estimate request form and fee to the Department of Community Development. One of the plan reviewers
will prepare estimates and check parcel and easement information based on the approved plans. The
County's Management Analyst will prepare bond agreement forms, which will need to be completed by
the owner and submitted along with cash, certificates or sureties for the amounts specified. The
agreements will need to be approved and signed by the County Attorney and County Engineer. This may
take 2-4 weeks to obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves
the application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the
remainder of the application fee. The form identifies the contractor and responsible land disturber, and
the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.
