The approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final site plan for all or a portion of the site within one (1) year after the date of this letter as provided in section 32.4.3.1 of Chapter 19 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final site plan. In accordance with Chapter 18 Section 32.4.2.8 Early or Mass Grading may be permitted after the following approvals are received: 1. Engineering approval of a VSMP plan meeting the requirements of Chapter 17 of the Code of the County of Albemarle. 2. Approval of all easements for facilities for stormwater management and drainage control. 3. Submittal of a tree conservation checklist with areas for tree preservation identified. The final site plan will not be considered to have been officially submitted until the following items are received: 1. A final site plan that satisfies all of the requirements of section 32.6 of Chapter 18 of the Code. 2. A fee of $1,613 for the final site plan application. Please submit 9 copies of the final plans to the Community Development Department. The assigned Lead Reviewer will then distribute the plans to all reviewing agencies (for ACSA, please submit 3 copies of construction plans directly to them, as stated in their comments). Once you receive the first set of comments on the final site plan, please work with each reviewer individually to satisfy their requirements. The Department of Community Development shall not accept submittal of the final site plan for signature until tentative approvals for the attached conditions from the following agencies/ reviewers have been obtained: 1. (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] Required Prior to Final Site Plan Approval: Planning (Tori Kanellopoulos) 1. 18-32.5.2 Requirements of an initial site plan. a. Ensure the final site plan submittal also meets all requirements for final site plans (18-32.6). b. For the Zoning overlay districts, only reference to `managed steep slopes' is needed — there are no preserved or critical slopes. c. Remove reference to `open space' on sheet 1. There is no open space required with this development. Recommend label as `undeveloped area' or similar. d. Include the zoning districts and uses of adjacent parcels. e. Include and label the DB/PG of any existing easements. 2. 18-4.11.4 Easements and structures. Per comments from reviewers on required easements (including ACSA and Engineering), ensure there is sufficient space for easements around required utilities that do not conflict with structures/buildings. 3. 18-4.12.13 and 4.12.18 Loading spaces. Provide one (1) loading space per 18- 4.12.13 meeting the design standards of 18-4.12.18. Loading spaces shall be provided in addition to and exclusive of any parking requirement on the basis of.- (1) one space for the first 8, 000 square feet of retail gross leasable area. 4. 18-4.17 Lighting plan. Provide a lighting plan meeting the requirements of 18- 4.17 with the final site plan submittal. 5. 18-32.7.9 Landscaping plan. A landscaping plan is required with the final site plan. The following are preliminary comments: a. 18-32.7.9.4: Show the requirements of the contents of a landscape plan, including existing landscaping/natural features and proposed landscaping. Provide a conservation checklist if trees are being retained. b. 18-32.7.9.5: Ensure street trees meet all of the relevant requirements, including minimum caliper and spacing. c. 18-32.7.9.6: 5 percent of the parking area will need to be landscaped. Ensure that parking spaces with the 2-foot overhang do not result in damage to landscaping. One large shade tree per 10 parking spaces is required. d. 18-32.7.9.7 Ensure all required screening meets the requirements of this section and of the ZMA application plan. e. 18-32.7.9.8 Ensure that there is at least 10 percent tree canopy for the site and that trees are 5+ feet after 10 years. f. 18-32.7.9 Ensure all plantings are on the County's approved list. 6. ZMA201900014 Application Plan: The following are comments regarding the application plan: a. Label the area for future Phase II on the site plan. b. Include the full building height note from the application plan, including the additional setback requirements for buildings over 35 feet in height. c. The front setback must be revised as currently shown on the plan. The ZMA application plan requires a 30' maximum setback from Route 29, which appears to be the Route 29 ROW. The proposal appears to be setback from the multiuse path by 30', but more than 30' from the ROW. 7. Additional applications: The following applications and approvals are required prior to final site plan approval: a. 18-32.7.4.2 and 18-32.7.5.3: Easement Plats: All new and adjusted easements must be shown on an easement plat, which must be approved prior to final site plan approval, and must match the final site plan. i. Offsite construction easements will be needed for the improvements/work shown on adjacent TMP 61-134. ii. Offsite ACSA easements will be needed. Offsite easements must be approved prior to final site plan approval. b. 18-32.7.4.1: Approval of a VSMP Plan is required prior to final site plan approval. See Engineering comments. c. 18-30.6: A certificate of appropriateness (COA) from the ARB is required prior to final site plan approval. Engineering (Emily Cox) 1. See attached comment letter dated June 4, 2020. VDOT (Adam Moore) 1. See attached comment letter dated June 9, 2020. Fire/Rescue (Shawn Maddox) 1. What will the building height be? If the height is going to exceed 30' then the travel way must be increased to 26' clear travel width. 2. If the building is going to be sprinklered the FDC must be shown and located within 100' of a hydrant. 3. A knox box will be required. Please provide a note indicating the requirement and that the location can be coordinated with the fire marshal's office. 4. Provide ISO needed fire flow for the building. 5. Provide available fire flow from a recent ACSA flow test. ACSA (Richard Nelson) 1. Submit PDF copies of the site plan directly to ACSA for review. 2. 3 offsite sewer easements will be required. 3. The condition of the existing water main will need to be evaluated prior to making a connection. This stub out is old and was never in use. The inside condition of the pipe should be verified with chlorination, pressure test and camera. If the segment is in poor condition, it will need to be replaced. 4. Move water meter to the other side of the storm drain. 5. Clarify ACSA and RWSA owned sewers. 6. Provide fixture counts to determine water meter size. 7. Confirm if Fire/Rescue will require a fire hydrant. Inspections (Michael Dellinger) 1. Add the following note to the general notes page: a. Retaining walls greater than 3 feet in height require a separate building permit. Walls exceeding 4 feet in height require a stamped engineered design also. Walls require inspections as outlined in the USBC. 2. Add the following note to the general notes page: a. Accessible parking spaces, access isles, and accessible route shall be installed in accordance with ICC ANSI A117.1-09. 3. Provide accessible parking detail on drawings. Architectural Review Board (Margaret Maliszewski) 1. No objection to initial site plan. At its meeting on June 1, 2020, the ARB approved the consent agenda and, regarding the initial site plan, identified no requirements to satisfy the design guidelines and no recommended conditions of initial site plan approval. Recommendations and requirements for final site plan were identified. See the ARB action letter. E911 (Brian Becker) 1. No Objection. The following comments will need to be addressed before approval: 1. WPO must be submitted and approved before final site plan approval. 2. VDOT approval will be necessary. 3. Engineering seal should be signed and dated. 4. [Sheet 1] Provide a date the topography survey was acquired. Date is provided on Sheet 2. 5. Please double check topography. It does not appear to match county GIS. 6. Work is shown offsite/outside of property lines. Permission or temporary easement will be necessary for this work. 7. Please note that retaining walls above 3ft will require a building permit and retaining walls above 4 ft will require stamped, engineered plans. 8. [Sheet 3] Please do not have landscaping directly over the SWM facility. 9. SWM facility and drainage pipe crossing the property line will need to be in easements with associated plats and deeds. 10. [Sheet 5] Please provide more spot shots to show grading at the entrance. 11. Please provide sight distance lines at the entrance. 12. Ensure that parking areas do not exceed 5% slope in any direction. They appear to be exactly 5%. 13. [Sheet 3]Please show dimensions for handicap accessible parking spaces. Proposed entrance does not meet the minimum spacing distance required. Please see VDOT's Road Design Manual appendix F., pg., F-23, minimum spacing distance standards for commercial entrances and intersections and median crossovers. As proposed an AM-E will be required. 2. Recommend sharing existing entrance with parcel# 61-134. 3. The entrance width needs to be a minimum width of 30'ft., please see VDOT's RDM, appendix F-pg., F-125, commercial entrance designs along highways with curb and gutter. 4. Note that the final site and subdivision/road plans must show conformance with the VDOT Road Design Manual Appendices B(1) and F, as well as any other applicable standards, regulations or other requirements. Please provide two copies of the revised plan along with a comment response letter. If further information is desired, please contact Willis Bedsaul at 434-422-9866. A VDOT Land Use Permit will be required prior to any work within the right-of-way.
