The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County Code.] [ZMA200100015] Proffer 4. In order to satisfy the terms of ZMA200100015, Proffer #4, please revise the Special Lot BLA Plat SUB202000016 to ensure that the proposed Presidio development and associated Special Lot "will provide reasonable provisions for access to the Greenway System" all the way (complete connection) between Peter Jefferson Parkway public right of way and the Rivanna Greenway property owned by the County of Albemarle. Currently, the Worrell Land & Development Company property creates a small gap or disconnection between the proposed adjusted Special Lot (reserved for future dedication to the County for public use) and the existing greenway property (owned by the County); a public use easement or dedication (or reservation of land for future dedication) involving a portion of the Worrell Land & Development Company property would ensure that Proffer #4 is satisfied. 2. [14-303(A)] Consent statement. Revise the owner consent statement to make it clear that this is not a subdivision creating a new parcel but the adding/subtracting of land from one parcel to an adjacent parcel. 3. [Comment] Parcel `X". Similar to the comment above, revise instances of "New Parcel `X"' to instead use "Area `X"' as the area name. This plat is not creating a new parcel. 4. [ZMA200100015, 14-302(B)(5), 14-302(B)(9)] Zoning notes. a. State here that the subject parcels are subject to ZMA20100015 and associated proffers. b. TMP 78-20M5 and TMP 78-20M6 are subject to different zoning overlay districts. Revise the Zoning notes to correctly identify to which overlay districts each parcel is subject. c. County GIS data indicates that the Flood Hazard Overlay District may not be present on these parcels, please confirm and revise the zoning -related notes accordingly, per Comment 4b above. 5. [Comment] Setback notes. Remove these notes from the plat. They are not necessary for the BLA and did not appear to be part of ZMA200100015. Please alert staff if setbacks are included in the aforementioned ZMA and if so, where they can be found. 6. [14-302(A)(4-5), 14-302(A)(15)] Easements. a. Label each easement shown on the plat as either public or private. b. Identify the owner of each easement, including the conservation easement and others. 7. [14-302(A)(9)] Building site. Add the following note to the plat: "TMP 78-20M6 contains a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance. TMP 78-20M5 is reserved as Open Space and is not required to have a building site." 8. [14-302(B)(4)] Grave/burial sites. Revise the plat note concerning burial locations to state the complete tax map parcel names — TMP 78-20M5 and TMP 78-20M6. 9. [14-302(B)(7)] Watershed. Revise the watershed protection note to more accurately state: "Subject Parcels do not lie in a Water Supply Watershed." 10. [14-302(B)(1)] General information. Since this is not a new application, note the original application date and the revision date(s) of each subsequent version of the plat. ACPR has identified the following required revisions: • In order to satisfy the terms of ZMA-2001-00015, Proffer #4, please revise the Special Lot BLA Plat SUB202000016 to ensure that the proposed Presidio development and associated Special Lot "will provide reasonable provisions for access to the Greenway System" all the way (complete connection) between Peter Jefferson Parkway public right of way and the Rivanna Greenway property owned by the County of Albemarle. ACPR recommends (but does not require) the following revisions: • Ensure the plat revision date is listed correctly (as may be applicable) • Add owner(s) name for the existing Conservation Easement within the Special Lot TMP 78-20M5 (deed book and page references are shown, but owner info is not shown) • The proposed BLA plat shows a very small portion of the existing Conservation Easement remaining on Presidio Apartments property (TMP 78-20M6). Please consider modifying proposed Lengths L20, L21, and L22 of the proposed Special Lot (TMP 78-20M5) to precisely follow the boundary of the existing Conservation Easement in this area. Although the County typically does not desire reserved or dedicated lands to contain existing easements, slight modifications to this part of the proposed Special Lot would: align the boundaries of the Special Lot and the existing Conservation Easement; keep the existing Conservation Easement entirely on one property; and help to avoid future confusion or difficulty by simplifying these boundaries. In accordance with the provisions of Z.O. 14-229 of the County Code, if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this letter, the application shall be deemed to have been voluntarily withdrawn by the applicant.
