Subject: SUB-2020-75 TMP 87-44B & 46 Parcels X & Y — Boundary Line
Adjustment
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat
referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
1. [14-302 (A)(2)] Vicinity Map. Revise the vicinity map to be at a scale of 1"=2,000' and
include the scale label below the vicinity map.
[14-302 (A)(4&6) & 14-303 (E)] Private Easements; Alleys and shared driveways;
Dimension standards and information on all lots, streets, alleys, easements, and shared
driveways. Address the following:
a) The deed for the triangular Ingress/Egress easement (DB 427 PG 412) is not only for
access but also for utilities. Confirm that there are no utilities within that area that
would still require an easement.
b) Ensure that there are no other easements that need to be revised or added because
of this land swap for the benefit of TMP87-46, TMP87-44B and TMP87-44A, such as
for utilities and access, within the areas being swapped and the easement being
vacated. Add any easement additions/revisions to this plat and provide drafts of any
legal documents required for the easement revision for County review.
c) The paved and gravel driveways shown on these two parcels appear to serve the two
subject parcels as well as TMP 87-44A. If any easements for shared driveways
exists, they must be labeled as "shared driveway easement". If legal
agreements/easement exist for these drives add this information (including deed
book and page number) to the plat and show and label the easements.
d) If the boundary line adjustment impacts other shared driveway easements, and/or
requires them to be modified/revised, include that in the plat and provide drafts of any
legal documents required for the easement revision for County review.
e) Also, if the triangular ingress egress easement (DB 427 PG 412) that is being
vacated gives right of access to more parcels than TMP 87-46 then it would be
considered a shared driveway easement, should be labeled as such, and all of the
owners of the easement should be included in the label.
[14-302 (A)(5) & 14-303(L)] Public Easements; Public utility, drainage and sight distance
easements. Show all existing public easements and provide labels for the owner and the
deed book and page number of the deed and easement. If a specific location for the
easement is not specified in the deed or plat that created it then include the information
(easement, owner, deed book and page number) in a note on the coversheet.
a) Add a note, or show an easement location, width and label, for the existing power
easements for both properties. This should include the easement holders name, the
deed book and page number for the deed, and if it was specified in the deed or
shown in a plat, the width of the easement.
b) As mentioned in the comment above, the deed for the triangular Ingress/Egress
easement (DB 427 PG 412) also specified that it was for utilities. If any utilities exist
in this easement area, or anywhere else on the two subject parcels show the
easement location(s), their width, their deed book and page number and their owner.
If a specific location was not designated, then this information can be included in a
note on the cover sheet.
c) If any utilities exist within the triangular ingress/egress easement that serve more
than TMP 87-46 address the need for the continuation of the utility easement(s).
4. [14-302 (A)(9)] Building sites on proposed lots. Add the required building site note that
states "Parcel [letter or number] and the residue of Tax Map/Parcel [numbers] each
contain a building site that complies with section 4.2.1 of the Albemarle County Zoning
Ordinance." Ensure it is revised to correctly state the labels and tax map numbers for the
subject parcels.
5. [14-302 (A)(10)] Right of further division of proposed lots. Add the required right of further
division note. Even though one of these parcels is less than 2 acres in size, each parcel
has one (1) development right since they existed before 1980. They do not have more
development rights because of their size. Please note that because of their size these
parcels may not be further divided.
6. [14-302 (A)(15)] Identification of all owners and certain interest holders. Add the
address(es) of the owners to the plat.
7. [14-302 (13)(1)] General information. Add the sheet number and number of sheets to the
plat (ex. Page 1 of 1).
8. [14-302 (13)(2)] Name of plat preparer. Include the name of the person who prepared the
plat and include the surveyors seal on the plat.
9. [14-302 (13)(7)] Reservoir watershed; agricultural -forestal district. Include notes on the
plat stating whether these parcels are within the water supply water shed or an
agricultural -forestal district.
10. [14-309 & 14-310] Soils evaluation; Health Director Approval. Show the location of the
existing drainfields (primary and reserve) serving the existing structures. It must be
shown that the drainfields are not located in the portion of the property that is being
transferred to the adjoining lot. This can be done on a separate exhibit if the applicant
does not wish to include it in the plat.
