Our comments are provided below and organized in the following manner: A. Comments on the Special Use Permit B. How the proposal relates to the Comprehensive Plan C. Additional comments from reviewers D. Draft conditions based on review comments E. Comments related to the Special Exception (SE202000002) A. Special Use Permit The proposal indicates that the requested veterinary use will be occupying an existing building space and will not require any exterior changes on the parcel — including no potential outdoor facilities for animals. As such, it is staff's opinion that sufficient information has been provided at this time by the applicant and no additional information is necessary in the form of a resubmittal prior to a public hearing. B. Comprehensive Plan Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of the staff report. The subject property of this proposal, TMP46B4-1A2, is designated as Urban Density Residential land use by the Places29 Master Plan. This land use designation is used by the Master Plan around activity "Centers" to denote areas where dense multifamily housing is desired (6.01-34 units per acres). Primary uses within this designation include multifamily and single-family residential while secondary uses include retail, commercial, and office uses that support the neighborhood, live/work units, open space, and institutional uses. Retail, commercial, office, and institutional uses are encouraged to locate in Centers, however, they may be located by exception (i.e. special use permit) in areas around Centers designated Urban Density Residential provided they are compatible with surrounding uses. The proposed veterinary use falls within the secondary uses described by the Master Plan. Staff find that the veterinary clinic is compatible and supportive of neighborhoods and residential uses by providing local, walkable care options for pets and small animals. C. Additional Comments from Reviewers Planning Comments The following comments related to planning matters have been provided by Mariah Gleason: 1. On Page 7 of the Application Narrative, it looks as though there may be a clerical error. The impact on Public Safety Items and/or Public Facilities description references Environmental Features section above. 2. Overall, no additional information or significant changes were identified that staff recommended be addressed by a resubmittal. Any comments from Planning will be included in the staff report to the Planning Commission. 3. Should the special use permit be approved, changes to the building cannot commence without the appropriate building permits. Zoning The zoning reviewer, Kevin McCollum, kmccollum(a)-albemarle.org, has no objections but offers the following comments: ii111111110C - • i OW . • e •.f[ire i��i As offered by the Applicant: Prior to the issuance of a building permit, the applicant must submit information to the satisfaction of the County Engineer and the Zoning Administrator (or their designees) that demonstrates the proposed use will not exceed the maximum sound levels described in County Code 18- 4.18. Development of the use shall be in general accord with the conceptual plan provided in Appendix A. There shall be no expansion of the building other than minor changes needed for renovations and soundproofing. As we have done with other veterinary office special use permits, Zoning would be in favor of conditioning the hours of operation. The Applicant has suggested their normal hours of operation are 8:00am to 6:OOpm, but Zoning would be ok if these hours were expanded to 7:OOam to 8:OOpm. This would give the applicant more flexibility and would keep these conditions consistent across different special use permits for this use. Engineering The County Engineer, Frank Pohl, fpohl albemarle.org, has no objections to this proposal. Entrance Corridor/Architectural Review Board (ARB) The ARB reviewer, Margaret Maliszewski, mmaliszewski(a)_albemarle.org, has no objections to this proposal, but offers the following comment: This proposal includes no changes to the site or the exterior of the building. Consequently, no visual impacts to the Entrance Corridor are anticipated. Fire/Rescue The Fire/Rescue reviewer, Shawn Maddox, smaddox(a albemarle.org, has no objections to this proposal. Virginia Department of Transportation (VDOT) The VDOT reviewer, Adam Moore, adam.moore(a�vdot.virginia.gov, has no objections to this proposal. Please see the review letter attached. Building Inspections The Building Official, Michael Dellinger, mdellinger(a�albemarle.org, has no objections to this proposal, but offers the following recommendation: The architect needs to coordinate with the Building Plans Reviewer (Keith Huckstep, khuckste(@albemarle.org) on alterations of building and must use the 2015 VA Existing Building Code. Albemarle County Service Authority (ASCA) The ACSA reviewer, Richard Nelson, rnelson(a)serviceauthority.org, has no objections to this proposal, but offers the following recommendation: The applicant should confirm if there will be any changes to the existing buildings fixture counts during the permit stage. If the water meter needs to be upgraded, there will be water and sewer connection fees. Rivanna Water & Sewer Authority (RWSA) The RWSA reviewer, Dyon Vega, has no objections to this proposal. Natural Resources The Natural Resources Manager, Kimberly Biasiolli, kbiasiolli a( albemarle.org, has no objections to this proposal. D. Draft Conditions based on Review Comments Staff has not fully drafted proposed conditions for this special use permit to date, however, staff will send proposed conditions to you once this has been completed. Potential proposed conditions: 1. Development of the use must be in general accord (as determined by the Director of Planning and the Zoning Administrator) with the exhibit titled "Airport Road Animal Clinic Relocation, SUP Exhibit," prepared by Line + Grade Civil Engineering, dated May 7, 2020. To be in general accord with the exhibit, development must reflect the following essential major elements of the Conceptual Plan: • No expansion of the building other than minor changes needed for renovations and soundproofing. • No outdoor exercise areas or runs. 2. The hours of operation for the veterinary use may not begin earlier than 7:00 a.m. and may not end later than 8:00 p.m. 3. No overnight boarding use, other than for those animals under medical care, may take place at the veterinary clinic. 4. Prior to the issuance of a building permit, the applicant must submit information to the satisfaction of the County Engineer and the Zoning Administrator (or their designees) that demonstrates the proposed use will not exceed the maximum sound levels described in County Code 18-4.18. E. Special Exception SE202000002 Planning The zoning map indicates that the subject property abuts a residential -zoned lot (TMP46B4-01-A3 having R-15 Residential zoning). Thus, the distance between the veterinary use (i.e. the building) and the nearest residential lot line would be approximately 120-125 feet. However, as the application materials demonstrate, the nearest lot with a residential structure is located further away. It appears separation between the proposed use and residential uses is being provided by the subject property's parking lot and the Common Area and landscaping associated with Gateway Village Townhomes. Thus, Planning has no objections to the Special Exception at this time, as sound associated with the veterinary clinic would still be subject to the noise regulations contained in Section 4.18 if this special exception request is granted. Zoning Zoning has no objection to this Special Exception. The issues of sound and hours of operation are addressed both by the conditions above and Sections 4.18 and 5.1.11 of the Zoning Ordinance. Engineering has no objections to the special exception request. ADDITIONAL INFORMATION Resubmittal If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal. Area Land Use Engineer VDOT - Charlottesville Residency VirginiaDOT.org WE KEEP VIRGINIA MOVING DEPARTMENT OF COMMUNITY DEVELOPMENT ACTION AFTER RECEIPT OF COMMENT LETTER FIRST SET OF COMMENTS Your project has been scheduled for a public hearing by the Planning Commission for September 1, 2020 which is within 90 days from the date your application was accepted for review. State Code requires a 90-day review by the Planning Commission unless the applicant requests deferral. If you wish to submit revised materials, they must be submitted by July 6, 2020 to maintain the 90-day schedule. If you need more time to make these changes, you must request deferral and you must submit revised plans. Instructions for requesting a deferral are outlined below. Within one week, please do one of the following: (1) Request to proceed to Planning Commission public hearing on September 1, 2020 (2) Resubmit in response to review comments by the date noted above (3) Request deferral, as required by Section 33.521, in these instances: a. If you will not be resubmitting by July 6, 2020 b. If you will resubmit but would like to receive comments on the revised submittal, and understand the Planning Commission date will be later than September 1, 2020 (4) Withdraw your application (1) Request to proceed to Planning Commission Public Hearing on September 1, 2020 At this time, you may request that your application proceed to public hearing with the Planning Commission on September 1, 2020. Be sure to include the resubmittal form on the last page of your comment letter with vour submittal. The application fee which you paid covers staff review of the initial submittal and one resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.) (3) Deferral requested To request deferral, you must submit a request in writing to defer action by the Planning Commission and Board of Supervisors. The request may be made by email. You may request a deferral for up to 36 months from the date your application was accepted for review, which is June 3, 2023. (This is based on the Board of Supervisors' September 5, 2018 action.) However, all outstanding information necessary for Commission action must be submitted by (February 3, 2023), according to the published schedule. (See Section 18-33.52 of the Albemarle County Code.) (4) Withdraw Your Application If at any time you wish to withdraw your application, please provide your request in writing. Failure to Respond An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral pursuant to subsection 33.52(A) and fails to provide within 90 days before the end of the deferral period all of the information required to allow the Board to act on the application, or fails to request a deferral as provided in subsection 33.52(B) or (C).
