RE: Old Trail Creekside
Dear Mr. Minnerly,
This letter is in response to your concern about access and roads as shown on the plat for Old Trail Creekside.
The County is not requesting you grant any easement or other rights to the developer of Old Trail Creekside.
The County has not requested the developer obtain any easement or other rights on your property. The
County is not seeking to gain any easement or other rights on your property on behalf of the developer. What
the County is seeking is that the plat submitted for Old Trail Creekside comply with the provisions of the
Subdivision Ordinance. These provisions in part require that the possibility of interparcel connection
(access) be accounted for on the plat. To that end the County is requiring the developer to extend the right of
way of the road network in Old Trail Creekside to your property line and show how access could be extended.
The reason we ask the developer to show how access could be extended is to insure that the alignment is
reasonably practicable for possible extension in the future. Extension of the road will only occur if and when
your property is developed. That is not to say that you have any plans to develop now or in the foreseeable
future. The County's planning efforts are designed to allow for the orderly development of the County and to
accommodate that development should it be proposed. The extension of the right of way in Old Trail
Creekside to the property line is required in order for the plat to comply with the Subdivision Ordinance.
