We are adjoining property owners to the proposed subdivision and have a few concerns that we would like to have addressed. We met with David Pennock, senior planner of the Zoning and Current Development Division, last Friday to review the site plans. Upon review of these plans it has come to our attention that the building sites on three of the lots, specifically lots 5, 6, & 7, are extremely close to the property line and our front yard. Mr. Pennock stated that the building set back for these three proposed sites is 35 feet. This set back seems very small given the rural nature of this proposed subdivision and the lot sizes of 3 -4 acres each. This is a rural area. Our house sits on 24.5 acres. We do not live in a subdivision, and have no desire to do so. Having these three houses built within 35 feet of the property line effectively puts them in our front yard and therefore puts our house in the subdivision. We are requesting that an increase in the building set back be considered, along with a buffer zone to help diminish the effects this subdivision will have upon the privacy of our property, especially with respect to site and sound. I would imagine that those looking to purchase lots in this rural area would appreciate this as well. There is also another issue that we would like to have addressed as well. There is a deeded right -of -way through our property to one of the lots in this proposed subdivision. It is our understanding that per new county code a lot in a subdivision must be accessed through that subdivision's road. This is noted on the proposed site plan. Therefore, we would like for the right -of -way through our property to be legally abandoned as part of the subdivision proposal. We are not opposed to the development of the subdivision. We do however need to look out for our interests and our property. It looks like things will be progressing quickly as there is a Site Review Committee Meeting on Thursday and a planning commission meeting on November 8th. It is our understanding that you are our spokesman at this point, so please take our concerns forward.
