The request is to allow for an 8'5" X 14' 7" cooler installation with an additional 8' X 10' storage area to be located near the rear of the existing building. Due to the simplicity of this request, I am reviewing it as a "Letter of Revision" to the latest approved plan [SDP 88-01 Jefferson Square Shopping Center Final Site Plan]. You are allowed a total of three (3) "Letter of Revisions" before the plan is required to be submitted as a Minor Amendment. Approval of this request is viewed as your first "Letter of Revision" approval. The Department of Planning and Community Development hereby grants approval of your request with the condition that the location of the cooler installation and the storage area is in accord with the attached sketch plan. Please make application for building permit at the Department of Building Codes and Zoning Services at your convenience. Please have Mr. Charles Lebo update, in accord with what you have submitted, the original Jefferson Square Shopping Center mylars for your records. The Department of Building Codes and Zoning Services will make the appropriate revisions to the existing mylars in our file. The changes should reflect the area designated as a cooler installation and the storage area. A copy of this letter will be put in our file "SDP 98-01 Jefferson Square Shopping Center Final Site Plan [Rio Hills]". Please accept this letter as final approval for you request. Charlottesville, Va. 22902-4596 Dear Eric: Per our conversation on 6-17-99, 1 am submitting a letter outlining my plans for a cooler installation. The business is located in the Rio Hill shopping center and it shares a common wall with Krogers. The plan will be to put the cooler behind the building. The area is not an area that is used by the customers of the shopping center. It is usually used for deliveries and employee parking however, it is not used to any great extant by anyone and the installation should not pose a problem for anyone. Drawing #1 show the existing situation with the parking and the relationship of The Brick Oven, Inc. to the other tenants. Drawing #2 shows the proposed cooler installation. It will occupy two existing parking spaces and it will be well away from any traffic lanes. I have enclosed a copy of a letter from Chuck Lebo that approves the project. John Steedman The Brick Oven 1966 Rio Hill Center, Charlottesville, Va. 22901 Dear John, I am pleased to inform you that your request to place your kitchen cooler behind your store at Rio Hill has been approved under the specifications you provided. I am ordering an addendum to your lease stating such approval. It shall also contain the following terms regarding your responsibility for this addition: 1. All construction shall be done by you, as tenant, at your sole expense and under all applicable building and health codes. 2. Upon your vacating your space at Rio Hill it shall be your sole responsibility to remove the cooler and its surrounding structure and put the rear area of the parking lot back into its original (present) condition. 3. All of your outside storage shall be placed within the confines of your new structure so that it shall no longer be visible. 4. All maintenance, insurance and upkeep of the new structure shall be made by you and at your expense. If you are in agreement with the terms herein please sign your acceptance and I can order the lease addendum. Once the addendum is delivered I will bring it over to you for signatures.
