This is extremely helpful for our evaluation of this project. Since the development requires the private pump station in order to get sewer service to the proposed land uses, it sounds like the applicant needs to get the Application for Certificate to Construct approved by DEQ prior to the County taking a final action on the rezoning request. Otherwise, if we approve the rezoning and the applicant later finds out that DEQ can't approve the Application for Certificate to Construct, the development won't be possible at all. I am going to send all of the information you provided to the applicant and ask them to begin the application/approval process for the Application for Certificate to Construct. Should I tell them to submit that application directly to you via email, or is there a web portal on the DEQ site that they can submit it to? Mr. Langille: For a private pump station as you have described in your email below, the owner must submit an Application for Certificate to Construct. On the Application for Certificate to Construct, the following statement must be signed and sealed by the Virginia licensed design engineer: `As discussed in 9 VAC 25- 790-240. C., the referenced design documents are in substantial compliance with Part 111- Manual of Practice For Sewerage Systems and Treatment Works, of the Sewage Collection and Treatment Regulations (9 VAC 25-790-310 et seq.)" The Sewage Collection and Treatment Regulations at 9VAC25-790-390 address reliability requirements for sewage pump stations. The Sewage Collection and Treatment Regulations state that the objective of achieving reliability protection is to prevent the discharge of raw or partially treated sewage to any waters and to protect public health and welfare by preventing backup of sewage and and subsequent discharge to basement, streets, and other public and private property. A Reliability Classification Worksheet must be submitted with an Application for Certificate to Construct for sewage pump stations. The following question is on the worksheet: 5. Is a public water supply surface water intake within 5 miles downgradient of the pump station or within 1 tidal cycle upstream of the pump station? [Contact the appropriate field office of VDH's Office of Drinking Water https://www. vdh. virginia.gov/drinking- water/contact-us/. Provide VDH with latitude/longitude information for the pump station and the average and peak design flows.] If yes, STOP - Reliability is Class L If no, proceed to Question 6. Class I Reliability is the highest level of reliability protection in the Sewage Collection and Treatment Regulations. The worksheet then requires that the method of complying with the reliability classification be identified. Following construction of the pump station, an Application for Certificate to Operate must be submitted. As part of the Application for Certificate to Operate, the certifying engineer must verify that all components are installed in accordance with the approved plans and specifications. An Application for Certificate to Operate is not to be submitted unless the site has power, all systems have been checked for proper operation, and all alarm and monitoring systems are operating properly. I was given your contact information from one of my colleagues, Frank Pohl (County Engineer). I am currently managing the review of a rezoning request for two pieces of land here in Albemarle County. The rezoning proposes to upzone the land so that up to 115 dwelling units and a veterinary clinic can be established across both parcels. Both parcels are in the jurisdictional area of the Albemarle County Service Authority, and the development (if approved) will connect to public water and sewer lines. However, ACSA is requiring that the developer install a private pump station within the development so that sewer service can be extended/connect to existing public sewer lines down the road. The County's Board of Supervisors has to approve private pump station requests under our Code of Ordinances. Frank & I must write a recommendation to the Board on whether the request should be approved or not. We wanted to ask if DEQ has any comments or concerns with doing a private pump station for this development. This development is located next to a perennial stream and there are some areas of 100-year FEMA floodplain on the north side of the parcels. The stream flows to the east toward the Beaver Creek Reservoir, which is one of the County's water supply impoundments. On previous private pump station requests elsewhere in the County, Board members have asked staff whether there are any significant concerns related to groundwater contamination should a private pump station fail. I think that is the most important topic to get your input on given the site's relation to the reservoir. If you could take a look and send me any comments DEQ has by Monday, July 27, I'd greatly appreciate it. I've attached some materials from the rezoning proposal. The document titled "ZMA202000005 Old Dominion Village" is a conceptual layout plan that shows where residential lots, streets, open space, environmental features, and other improvements would be located if the rezoning gets approved.
