Simpson 22630 Davis Drive, Suite 200 Sterling, Virginia 20164 October 20, 2005 Re: SDP 05 -051 Chick -fil -A Preliminary Site Plan Dear Mr. Simpson: The Department of Community Development hereby grants administrative approval of the above - referenced site plan. In accordance with Zoning Ordinance Section 32.4.3.1, approval of the preliminary site plan is valid for one (1) year. Therefore, this approval shall expire October 20, 2006. If the preliminary site plan approval expires before all final tentative approvals have been granted, a new application must be filed and processed. Please address all of the requirements and conditions listed below and submit eight (8) copies of the tentative plan to the Current Development Division, in care of the Community Development. This letter must be submitted with the tentative plans, as a checklist, to document that you have addressed all requirements and conditions, or the tentative plan will be denied. The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan, with the associated applications and fees, may also be submitted with the eight (8) tentative plan copies. Failure to do so will result in a separate application to be filed at a later date. After the initial tentative plan submittal, each department /agency will contact you to discuss any remaining conditions. After all aforementioned departments /agencies have granted tentative approval, you may submit the final mylars (2 sets), one blueprint or paper copy, the final site plan application along with the final site plan fee ($410), and a copy of all written tentative approvals to the Department of Community Development by 5:00 p.m. on any week day. Assuming that the site plan mylars reflect the required conditions of all final tentative approvals, signing of the plans will occur within one week. The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in addition to the following conditions. The Planning Department shall not accept submittal of the final site plan for signature until tentative approvals for the following conditions have been obtained. The final site plan shall not be signed until the following conditions are met: Chick -fil -A Preliminary Approval October 20, 2005 Page 2 A. Current Development planning review approval to include: ❑ 1. [32.5.6(i)] If the site of this development is to be separated from the Lowes site through a future subdivision, an access easement shall be established across the Lowes property in order to connect this site with the nearest public road (Woodbrook Drive). ❑ 2. [32.6.66)] Submittal of a description and photograph or diagram and show the location of each type of outdoor luminaire that emits 3,000 or more initial lumens, including any wall- mounted lighting. ❑ 3. [32.6.66)] [4.17.4(b)] Submittal of a photometric plan on the site plan demonstrating that all parking area luminaires are in compliance with 4.17.4 b. Please note that the photometric plan must show lighting values up to all adjacent roadways and any property lines shared with rural or residentially -zone properties. ❑ 4. [32.7.9.4(b)] A conservation plan checklist must be completed and incorporated into the site plan with notes to show how any individual trees and groups of trees designated to remain will be protected during the construction of this project. The locations of any tree protection fencing that coincides with the limits of clearing and other methods of protection from the checklist must be shown on the plan for clear identification during field inspections. ❑ 5. [32.7.9.7(b)] An area of interior landscaping equal to five (5) percent of the paved parking and circulation area shall be provided, including the provision of one (1) tree for every ten (10) parking spaces. Please be aware that this shall be a calculation of the total ground area dedicated to those interior plantings and not the sum of the canopy to be provided by those items at ten (10) years maturity. In accordance with Section 32.7.9.8(b), please note that the evergreen trees screening the parking lot from the adjacent property zoned Rural Areas cannot be counted toward the interior landscaping requirements. ❑ 6. [32.7.9] Submit an amended landscape plan showing all existing landscape features, required additions and the replacement of the trees that are proposed to be remove. ❑ 7. Provide a signature panel on the cover sheet with approval lines for the following agencies and/or individuals: Planner (Current Development) Fire /Rescue Division Engineer (Current Development) Building Official Service Authority Virginia Department of Transportation Architectural Review Board ❑ 8. [30.6] Architectural Review Board approval and issuance of a Certificate of Appropriateness. ❑ 9. Demonstration of compliance with all requirements and conditions of approval for the special use permit SP 2005 -017. B. Current Development engineering approval to include: ❑ 1. Submittal of a tentative final site plan that complies with all applicable items as specified in the Design Standards Manual, section 902. C. Albemarle County Service Authority approval to include: ❑ 1. Final approval will not be granted until the domestic water meter is removed from the pavement to the traffic island. Also, the backflow device goes behind the meter and the 2" gate valve(utility note 17) is not needed. Chick -fil -A Preliminary Approval October 20, 2005 Page 3 D. Albemarle County Division of Fire and Rescue provides the following comment: ❑ 1. Approval is subject to field inspection and verification.
