HomeMy WebLinkAboutSUB201800171 Review Comments Road Plan and Comps. 2020-07-170 County of Albemarle Department of Community Development 401 McIntire Road, Charlottesville, VA, 22902 Memorandum To: John Anderson From: Christopher Perez, Senior Planner Division: Planning Date: 7-17-20 Subject: SUB201800171 Lewis and Clark Road Plan - Revised Landscaping The County of Albemarle Planning Division will grant or recommend approval of the road plan amendments referenced above once the following comments have been addressed: 1) 114-106,14-422, 14-235, 14-311, 14-317, ZMA2005-3, ZMA2005-3 Exhibits A-M] The rezoning and the proffers associated with the project require street trees for the public road, the trees are required to be in the right-of-way. Because the applicant is not planting them in the right-of-way and instead are planting them on private property they shall be placed in a landscape easement and a maintenance agreement shall be provided. Prior to road plan approval an easement plat and a maintenance agreement for the improvements that are outside the right-of-way are required to be approved by the County and recorded in the Clerk's Office. If the 10' wide multiuse path is outside the right-of-way it also needs to be included in the easement and maintenance agreement as well. Rev 1. Per conversations with senior staff we are willing to permit the road plan to be approved prior to the landscape easements being recorded. The road plan shall still depict these proposed easements. The landscape easements shall be recorded on the right-of-way dedication plat that is required. Once you submit the right-of-wav dedication plat for County review, if you want me to send the existing CCR document to the County Attorney for consideration to cover the landscaping as the maintenance agreement. I will. Either way I'll need some sort of maintenance agreement approved by the County Attorney for these improvements prior to plat approval. 2) 114-422,14-106, 14-311, 14-317, ZMA2005-3, ZMA2005-3 Exhibits A-M] Has a right-of-way dedication plat ever been approved by the County for this section of roadway? If not, one shall be provided and the plat shall contain the offsite landscape easement to cover the required street landscaping that is proposed outside the right-of-way. If such a plat has already been approved and recorded then the landscape easement mentioned above shall be provided on a separate plat. Rev 1.
