TMP 65-15, TMP 65-15B, TMP 81-57 and TMP 81-58 are each zoned RA. 3. In early January 1992 (1/9/92), a subdivision of TMP 65-15 was approved that created a 2.01 acre lot, which was assigned one (1) development right, leaving what was noted as a 324.45 acre residue with four (4) development rights. In late January 1992 (1/22/92), a Letter of Determination was approved and found that TMP 65-15 was four (4) parcels of record, TMP 65-15, TMP 65-15B, TMP 81-57 and TMP 81-58 and that each parcel had five (5) development rights. The 2.01 acres were clearly divided from TMP 65-15 (see Deed Book 1208-451) and retains one (1) development right, which is shown on this plat as "TMP 81-52A", and TMP 65-15 retains four (4) development rights. Currently, TMP 65-15B, TMP 81-57 and TMP 81-58 each have five (5) development rights. The New Residue TMP 65-15 (61.79 acres) is assigned one (1) development right, and when further divided, it shall not consist of more than 2.0 acres. Area "X" (99.08 acres) is assigned three (3) development rights, and when further divided, it shall not consist of more than 26.99 acres. There is no intent by this plat to combine or waive any development rights that may exist. 4. According to the Albemarle County GIS website, New Residue TMP 65-15 (Old TMP 65-15 less Area "X") and New Revised TMP 81-57 (Old TMP 81-57 Plus Area "X") each contain a building site that complies with Section 4.2.1 of the Albemarle County Zoning Ordinance. 5. TMP 65-15, TMP 65-15B, TMP 81-57 and TMP 81-58 each are located in the Mechunk Creek Watershed and each are not located in a water supply watershed or agricultural -forestal district. 6. TMP 65-15 (which includes Area "X") and TMP 65-15B are located in the Entrance Corridor and Flood Hazard Overlay Districts. TMP 81-57 and TMP 81-58 are located in the Flood Hazard Overlay District. 7. TMP 65-15 (which includes Area "X"), TMP 65-156, TMP 81-57 and TMP 81-58 are subject to an Open Space Easement to the Virginia Outdoors Foundation dated December 28, 2005, and recorded in Deed Book 3130, page 429. See also other transfers of property subject to the same Open Space Easement in Deed Book 5054, page 1 and Deed Book 5121, page 418. 8. TMP 65-15, TMP 65-15B, TMP 81-57 and TMP 81-58 appear to lie in areas designated as Zone A and Zone X, as shown on F.E.M.A. Flood Insurance Rate Map, Community Panel 51003C0325D, effective date 02-04-05. 9. The stream buffers shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance. 10. Through access along the existing farm road shall be terminated at its crossing of new property line, designated hereon as line L10. 11. Places of burial were not found or otherwise known to exist on these properties. 12. Title report furnished. 13. This plat is based on a current field survey.
