COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road, Room 227 Charlottesville, Virginia 22902 -4596 Phone (434) 296 -5832 Fax (434) 972 -4126 November 9, 2005 Eric Goetz Weather Hill Homes, Ltd. 703 East Jefferson Street Charlottesville, VA 22902 Re: U.S. Joiner - parking determination (TM 56A2, Section 1, Parcels 31 and 32) Dear Mr. Goetz: This letter serves to provide a written record of the parking determination for the above - noted property as reflected on the revised final site plan (amendment) by Muncaster Engineering entitled "US Joiner." This is the same site plan amendment that was approved by the County on October 27t" The previously approved site plan proposed 1 st and 2nd floors of 8,133 sf and a 3rd floor of 6,638 sf. This is a total of 22,904 gross sf. Based on the ordinance standard for 80% net and 1 space per 200 square feet of office use, 93 parking spaces were required (calculated per floor). A total of 103 parking spaces were provided with the site plan. This new commercial building is proposed with building permit B2005 -5661 NC. The recent site plan amendment added a basement of 8,132 sf. This building addition is being permitted without the requirement of additional parking spaces, based on our understanding of the limitations with several conditions of use for this building. These conditions of use are the basis for this parking determination. Any zoning clearances for current or future users will be limited by these conditions, until and unless a future parking determination is made to amend this one. They are as follows: 1. The net office area for the building (for the purpose of determining parking requirements) is a maximum of 19,632 sf. 2. Of the 8,132 gross sf, only 800 sf in the basement is usable active area. This area is proposed for a private dedicated exercise room which may only be used by the employees of this building. Eric Goetz November 9, 2005 Page 2 3. The remaining 7,332 gross sf shall be limited to storage use only and may not be occupied as active offices. Any conversion of this space to active office area (with offices, meeting rooms or the like) will be a violation of this approval. Each designated storage area in this basement shall be limited in terms of electrical and telephone service. We can understand how one telephone jack and four electrical outlets may be necessary. It is recommended (not required) that the ceiling height in each storage area be reduced to a maximum head room of 6 feet 6 inches. This is a common zoning practice for cases in which parking is reduced based on substantial area devoted to storage. 4. We recommend that the applicant consider areas on this property or offsite, where additional parking could be provided in the future. This additional parking could be used if the initial tenants or future tenants need additional parking (with or without the conversion of the storage area to active space). 5. Any future tenants will be subject to compliance with our parking regulations. The current parking analysis assumes a general office use. Certain office uses and additional commercial uses, such as dental clinics and service industries, are not approved under this determination. Future tenants may be limited by available parking. (Please check with us prior to finalizing leases with future tenants.) If you have any questions, please do not hesitate to ask. If there are corrections or revisions to these assumptions or conditions, please inform me. If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of the date notice of this determination is given, in accordance with Section 15.2- 2311 of the Code of Virginia. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application must be completed and filed along with the fee of $120. The date notice of this determination was given is the same as the date of this letter. Sincerely, Amelia G.
