County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any
VSMP permit by issuing a project approval or denial. This project is denied. The rationale is given in the
comments below. The application may be resubmitted for approval if all of the items below are satisfactorily
addressed. The VSMP application content requirements can be found in County Code section 17-401.
A. General
1. Show off -site disturbance in an easement. Record with plat.
2. Submit a floodplain development permit for proposed disturbance in the floodplain.
3. Submit a mitigation plan for proposed disturbance in the stream buffer.
B. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. You'll need to update Section 5. See comment D.1.
2. Complete Section 9 prior to approval.
C. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. Show staging, stockpile, borrow, concrete washout locations on the PPP. Also, show
locations where concentrated stormwater may discharge.
2. Show possible stockpile/waste areas with silt fence around it.
3. Provide detail of concrete washout on the plans or with PPP.
D. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP.
This plan is disapproved, and the reasons are provided in the comments below. The stormwater
management plan content requirements can be found in County Code section 17-403.
1. You're discharging into a natural channel/stream and therefore site runoff must
satisfy Energy Balance regardless if the 2 LOA criteria are met in 9VAC25-870-
66.B.4.
2. Show letter of availability from the nutrient bank provider on the plans if you
intend to purchase credits. Currently, VRRM shows 2.84 Ib/yr credits required.
3. Show Forest/Open Space protected in an easement. Submit an easement plat. Plat
& deed will need to be recorded prior to VSMP plan approval.
4. Please include these notes:
7. THE FOREST AND OPEN SPACE EASEMENTIS SUBJECT TO THE
GUIDANCE SET FORTH BY DEO /N THE VIRGINIA STORMWA TER
MANAGEMENT PROGRAM. THE AREAS WILL REMAIN UNDISTURBED /N A
NATURAL, VEGETATED STATE, EXCEPT FOR ACTIVITIES AS APPROVED
BY THE LOCAL PROGRAM AUTHORITY, SUCH AS FOREST
MANAGEMENT, CONTROL OF INVASIVE SPECIES, REPLANTING AND
REVEGETA TING, PASSIVE RECREATIONS (E.G. TRAILS), AND LIMITED
BUSH -HOGGING TO MAINTAIN DESIRED VEGETATIVE COMMUNITY (BUT
NO MORE THAN FOUR TIMESA YEAR, EXCEPTAS PERMITTED BY
EXISTING EASEMENTS AND AGREEMENTS). FURTHER, THE
CONSTRUCTION, INSTALLATION, RELOCATION, REPAIR, REPLACEMENT,
OPERATION, AND MAINTENANCE OF NEW OR EX/STING PUBLIC UTILITY
STRUCTURESAND FACILITIES SHALL BEPERM/TTED WITHIN THE
FOREST AND OPEN SPACE EASEMENTS AND ACCESS TO SUCH
STRUCTURES AND FACILITIES SHALL BE PERM/TIED AS DESCRIBED /N
EXISTINGAND FUTURE UTILITY EASEMENTS AND AGREEMENTS.
8. NO BUILDINGS STRUCTURES, OR PERMANENT ROADS (PUBLIC OR
PRIVATE) ARE PERMITTED IN SWM OPEN SPACE AREAS, EXCEPT FOR
STRUCTURES AND FACILITIES ASSOCIATED WITH PUBLIC OR PRIVATE
UTILITIES(PIPES, VALVES, MANHOLES, ETC) PROVIDED, HOWEVER,
THATAFTER CONSTRUCTION, INSTALLATION, REPAIR, REPLACEMENT,
OPERATION, MAINTENANCE OR REMOVAL OF SUCH UTILITIES, ANY
DISTURBED SOIL SHALL BE RESTORED TO ITS ORIGINAL CONDITION
OR AN ENGINEERED SOIL MIX SHALL BE PLACED PER THE DESIGN
SPECIFICATIONS, AND THE SWM OPEN SPACE AREA OR AREAS SHALL
BE RETURNED TO A NATURAL VEGETATED STATE.
5. Provide inlet & ditch drainage area maps and determine appropriate liner for ditch needed.
i.e. / 1.11111111 1 1
6. Velocity is excessive at AO & BO outlets. Try to reduce below lOfps. Also, add ES-1 at outlet
end.
7. Provide HGL in profiles (LD-347).
8. Show roof drains connections. Provide sizing & inlet design for the `yard drains'. Show
profiles & point of connection (invert out) locations.
E. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is disapproved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
1. Sheet 1: Designer to verify existing site conditions and topography are accurate. Provide
date of field verification: Topography should be visually field verified by within the last
year.
2. Sheet 2: Show the floodplain.
3. Sheet 3: Please show existing drainage divides.
4. Construction Entrance: Show location of sediment trapping device.
5. Sediment Traps: The height, H (ft.) are reported incorrect in the table on sheet 14 and need
to match the height shown on the plans. See the width to height table below.

The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process:
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond
estimate request form and fee to the Department of Community Development. One of the plan reviewers
will prepare estimates and check parcel and easement information based on the approved plans. The
County's Management Analyst will prepare bond agreement forms, which will need to be completed by
the owner and submitted along with cash, certificates or sureties for the amounts specified. The
agreements will need to be approved and signed by the County Attorney and County Engineer. This may
take 2-4 weeks to obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the entails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the
remainder of the application fee. The form identifies the contractor and responsible land disturber, and the
fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.
County forms can be found on the county website forms center under engineering;
