Mitchell (Applicant) petitions the Board of Zoning Appeals to issue a special use permit for one (1) sign to be located in a public right-of-way in accordance with Section 4.15.7(c) of the Albemarle County Zoning Ordinance. PROPOSAL: The applicant proposes to erect one (1) sign in the public right-of-way of the street that is considered the middle entrance to the North Pointe planned development. This sign will contain the name of the development and will be illuminated. The North Pointe development is zoned PD-MC, Planned Development Mixed Commercial. A sign in a public right-of-way is authorized only by a special use permit granted by the board of zoning appeals under section 34.5, provided that a sign permit required by section 4.15.5 is also obtained for the sign, the sign complies with all applicable requirements of this section 4.15, and shall satisfy the following: 4.15.7 (c) 1. Eligibility. The sign: shall be a either a subdivision sign or a sign at an entrance to a planned development authorized by sections 19, 20, 25, 25A, and 29; ii. the subdivision or planned development shall abut the public right-of-way in which the sign will be located; iii. the regulations applicable to freestanding signs for the subdivision or planned development, except for setback regulations, shall apply unless the Virginia Department of Transportation imposes more restrictive standards; and iv. the applicant submits a written statement from the Virginia Department of Transportation stating that it will permit the sign to be located in the public right- of-way. 2. Authorized locations. The sign shall be located only where the Virginia Department of Transportation authorizes it to be located. The sign meets all of the applicable regulations for freestanding signs within the PD-MC zoning district. ARB design criteria will be met. No substantial detriment to adjacent parcels or roadways. wCharacter of the district unchanged. With the sign as proposed and subject to the applicable ARB design criteria, staff believes that there will be no change to the character of the district. w Harmony. As previously noted, this proposal is in harmony with applicable Zoning Ordinance regulations, and there are no applicable regulations in Section 5 for signs. w Consistency with the comprehensive plan. The Comprehensive Plan does not directly address uses such as this. However, if the sign meets the ARB design criteria, it would be consistent with the Comprehensive Plan. Summary and Recommendation: Staff believes that this proposal satisfies the goals of the sign regulations and the criteria for issuance of a special use permit subject to the proposed conditions. w Staff recommends approval of this request, with the following conditions: 1.
