Ray, LS Land Planners Albemarle County Planning Commission November 17, 2005 401 McIntire Road Charlottesville, Virginia 22903 ATTN: Bill Fritz RE: Tax Map 32 Parcel 17 (Gold Leaf Land Trust No. 3) To Commission Members: On behalf of my client, Gold Leaf Land Trust No. 3, and as allowed in Section 14-225,1 of the Albemarle County subdivision ordinance, this is a request for a waiver or modification of Section 14-409 of the Albemarle County Subdivision Ordinance. This request is not to require the extension of the street to the adjacent property. Please find enclosed two copies of a sketch plan showing a possible division of Tax Map 32 Parcel 17, The property owner has a prospective purchaser for the proposed Parcel F, containing 10.00 acres. The requirements of the prospective purchaser is that the property is a minimum of 10.00 acres, and that it can be developed as one contiguous site. Extending the right-of-way and road to the adjoining property to the west or north would not be needed or desirable due to the existing development on these parcels and the steep slopes and stream on the north portion of this parcel. We are not aware of any official plan for development on the property to the east of this parcel. Therefore, we are requesting that our right-of-way not be extended to the adjacent property to the east. Our goal and objective is to obtain approval of an approximate road location that will allow for the creation of the proposed Parcel F, containing 10.00 acres, as shown on the enclosed sketch plan.
