HomeMy WebLinkAboutSP200400036 Legacy Document 2006-01-12 (8)Original Proffer Amended Proffer (Amendment # ) PROFFER FORM Date: ZMA # 04-011 Tax Map and Parcel Number(s) TMP 78-413 and TMP 78-4A1 2.142 Acres to be rezoned from C-1 to HC Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the owner, or its duly authorized agent, hereby voluntarily proffers the conditions listed below which shall be applied to the property, if rezoned. These conditions are proffered as a part of the requested rezoning and it is agreed that: (1) the rezoning itself gives rise to the need for the conditions; and (2) such conditions have a reasonable relation to the rezoning request. 1. The development on TMP 78-413 and TMP 78-4A1 shall be in general accord with the plan produced by Terra Partners, LLC, dated October 19, 2004, last revised May 9, 2005, entitled "Williams Property", herein referred to as the plan. The limits of disturbance shown on the approved final site plan shall not be significantly different from the limits shown on the Application Plan. 2. Permitted uses of the property, and/or uses authorized by special use permit, shall include only those uses allowed in the C-1 District (Section 22 of the Albemarle County Zoning Ordinance in effect on March 15, 2005, a copy of the section being attached hereto). An additional permitted use of the property shall include machinery and equipment sales, service, and rental as allowed for in the HC District. 3. The character of the development shall be based on the form, massing, character, and detailing that draws upon and is compatible with the proposed building elevations produced by C.W. Hurt Contractors, LLC, dated December 28, 2004, entitled "C'ville Power Equipment", hereto attached. Conformity with the proposed building elevations will be reviewed and approved by the Director of Planning in consultation with the County's Design Planner. If any conflicts arise between the Director of Planning's interpretation and the County's Architectural Review Board requirements, then the Architectural Review Board's requirements shall take precedence.
