[General Comment] There are two dashed lines running north/south located near the proposed 10' private trail easement that are not labeled and do not appear to represent property lines or existing easement boundaries. Please verify what those lines are supposed to represent. These two lines are located near line segments L8 and L9. Rev. 1: Comment addressed. 2. [General Comment] Note numbers repeat. There are two notes 5-8. Please revise. Rev. 1: Comment addressed. 3. [14-302 (A)(3)] In the street label, please state the deed book and page number of the recorded instrument that dedicated the existing portion of Eastern Avenue that is visible on this plat. Rev. 1: Comment addressed. 4. [14-302 (A)(4) and 14-302 (A)(5)] It appears that the proposed 20' drainage easement, a portion of the variable width private trail easement, the 10' wide private trail easement, and the new 20' ACSA sanitary sewer easement are going to be located on TMP 056KO-00-04-OOOAO, not TMP 056KO-00-00- 000A2. Please address the following: a. 114-302 (A)(1)] State TMP 056KO-00-04-000AO in the subdivision title. Rev. 1: Comment addressed. b. [14-302 (A)(4)] Please indicate who will own and maintain the proposed variable width private trail easement and the 10' trail easement and provide the instrument number that is stated as 3XX in the first note #8. Rev. 1: Comment addressed. c. [14-302 (A)(4) and 14-302 (A)(5)] Please indicate in the easement label whether the new 20' drainage easement will be public or private. A deed may be required for this easement. Rev. 1: Comment not fully addressed. Drainage easement deed under review with County Attomey. Rev. 2: Comment stands, drainage easement has been forwarded to the County Attorney. d. [14-302 (A)(11)] State the instrument that created TMP 056KO-00-04-000AO in a note. State the correct TMP number, TMP 056KO-00-00-OOOA2. Rev. 1: Comment addressed. c. Mentioning setbacks is not required for BLA plats, so do not include the text from Note 9 that mentions setbacks. Rev. 1: Comment addressed. 7. (14-303 (H)] Please show and identify the location and material of all permanent reference monuments. Monuments found or installed prior to plat recordation may be referred to if they are permanent and undisturbed. If any monument required by this chapter will be installed after recordation of the final plat, the certification of the professional engineer or land surveyor shall so note. Rev. 1: Comment addressed. 8. [14-303 (L) and 14-4211 It appears that the shaded area that is being vacated represents an existing easement? Please state the deed book and page number of the recorded instrument that created that easement. Rev. 1: Comment addressed. See ACSA no obiecfion email correspondence. 9. [14-428] Please revise the callout for the Eastern Avenue right-of-way dedication. It should state "0.987 Parcel X Variable Width Public Right -of -Way Hereby Dedication to Albemarle County for Public Use." Rev. 1: Comment addressed. New Comments First Revision: 10. 114-302 (A)(5)] Sheet 3 of the plat shows a ­50' Greenway Trail" on TMP 056KO-00-00-OOOA2. The label states that this was recorded in DB 4319, page 403. However, that plat was for a phase north of this site and did not create a 50' public greenway easement on TMP 056KO-00-00-OOOA2. Staff did find a plat recorded in DB 4769 pages 262-271 that platted a 50' public greenway easement on TMP 056KO- 00-04-OOOAO. A plat was also found recorded in DB 5075 pages 664-690 that appears to have reserved a variable width greenway easement for future dedication to Albemarle County on TMP 056KO-00-00- 000A2 and a variable width greenway easement on TMP 05600-00-00-057B2. Please make the following revisions: a. On Sheet 3, revise the label for the greenway easement on TMPs 056KO-00-00-OOOA2 and 05600-00-00-057132 so that it states "Variable width greenway easement to be dedicated to Albemarle County with future phase, DB 5075 page 664-690." 2°" Revision: Comment addressed. b. Sheet 3, revise the boundaries of the greenway easement on TMP 056KO-00-00-OOOA2 so that it reflects the recorded plat in DB 5075 page 687. 2°" Revision: Comment addressed. c. Sheet 3, revise the label of the existing 50' public greenway easement on TMP 056KO-00-04- 000AO so that it states the correct recorded instrument, DB 4769, pages 262-271. 20d Revision: Comment addressed. d. On Sheet 3, revise the boundaries of the greenway easement on TMP 05600-00-00-057132 so that it matches the recorded plat in DB 5075 pages 664-690. 2°d Revision: Comment addressed. 11. [14-302 (13)(5)] Revise note #15 on Sheet 1. TMP 056HO-00-00-00000 is subject to the proffers and Application Plan of ZMA2006-01. 2" Revision: Comment addressed. 12. [14-303 (D)] The Area Calculation that was on the first plat has been removed. This needs to be added to the plat so it clearly states the acreage of land being added/subtracted to all affected parcels. Existing acreages of TMPs 056KO-00-04-000AO and 056KO-00-00-000A2 need to be stated, and the revised acreages based on the land dedication for Eastern Avenue need to be subtracted and a new acreage for both TMPs calculated. Rev. 2: Comment addressed. a. Revise the acreage figure for TMP 056KO-00-00-000A2 on Sheet 3. It states 2.706 acres, but it appears that the residue acreage will be 5.259 acres per label on Sheet 2 once Parcel X is subtracted. Rev. 2: Comment addressed. New Comments 2" Revision: 13. Remove note 8 on Sheet VI. This is not needed. 14. [14-302 (A)(5), 14-429, 14-440] The County Attorney's office is recommending several changes related to vacating existing greenway easements and platting new trail/greenway easements. This requires several changes as follows: a. Please revise the labels for the "new variable width public trail easement" on Sheet V5 so that the labels state "new variable width public greenway easement hereby dedicated to Albemarle County for public use." b. Revise Note 1 on Sheet VI so that it states "creating a new public greenway easement" instead of "new trail easement." c. Revise the deed of dedication accordingly so that the easement name is changed to greenway easement instead of trail easement. Greenway easement deed of dedication template is attached. d. The greenway easement on TMP 056KO-00-00-000A2 was reserved for future dedication to the County on a plat recorded in DB 5075, page 664. The easement on TMP 056KO-00-04-000AO was dedicated to the County on a plat recorded in DB 4769, page 262. The callouts on Sheet V3 should clearly state both instrument numbers. Please shade the sections of the easements differently or draw a boundary line to differentiate between portions of the greenway easement that were recorded in either plat. e. Upon further direction from the County Attorney's office, the existing greenway easements on TMPs 056KO-00-04-000AO and 056KO-00-00-000A2 do not need to be vacated. Vacation of these easements would require a public hearing. The right-of-way and greenway easements can overlap. On Sheet V3, revise the easement labels so that they do not state "hereby vacated." f. Revise Note 1 on Sheet V 1 so that it does not state that any greenway easements are being vacated. Virainia Department of Transportation VDOT had previously stated no objection to this plat, but this was prior to revising the plat so that ROW is being dedicated as opposed to creating public drainage easements as originally proposed. The revised plat has been sent to Max Greene, max. rg eene@vdot.vir ig nia.gov, for review. Comments or approvals from VDOT will be forwarded to the applicant upon receipt.
