Def init ions – Generally, Sec 30.3.02.2, Determinat ion of Floodway & Floodway Fringe in the Approxim at ed Flood
Plain, Sec 30.3.05.1.2, By Right W/in the Floodway Fringe, Sec 30.3.07, Amendm ent of t he Flood Hazard Overlay
District, & delet e Sec 30.3.06.2, Finding of Count y Engineer, of Chapter 18, Zoning, of t he Albemarle Count y Code.
The boundaries of t he Flood Hazard Overlay District are t hose areas w/in t he Count y subject to inundat ion by t he
wat ers of t he one hundred year f lood, based upon m aps result ing f rom a flood insurance study prepared by t he
Federal Insurance Adm inist ration, Federal Emergency M anagem ent Agency (FEMA). Recent detailed st udies
prepared by FEM A have result ed in new maps t hat will est ablish revised boundaries of t he Flood Hazard Overlay
District. This ordinance would amend Sec 30.3.01, I nt ent , to also refer t o FEM A; am end Sec 30.3.02.1, Def init ions
Generally, to specify t hat the source for delineat ing the boundaries of the Flood Hazard Overlay Dist rict is t he new
f lood insurance st udy prepared by FEMA, eff ect ive February 4, 2005; amend Sec 30.3.02.2, Det ermination of
Floodway & Floodway Fringe in the Approxim at ed Flood Plain, to provide t hat the procedure applies only to
determine t he f loodway fringe in t he approximated flood plain; amend Sec 30.3.07, Am endment of t he Flood Hazard
Overlay District, t o add t hat the boundaries of the district m ay be revised, am ended or modif ied upon completion of
an aut horized fill operat ion (superseding & being the basis f or deleting Sec 30.3.06.2, Findings of County Engineer),
or where changes are indicat ed t hrough FEMA’s issuance of letters of map am endment or let ters of m ap revision;
amend Sec 30.3.05.1.2, By Right W/in the Floodway Fringe, to allow pedest rian & mult iuse paths w/in County parks
& dedicat ed greenways, & f oot bridges.
25. ZM A2004019. Flood Hazard Overlay Di strict (FH). This proposed amendment t o Chapt er 18, Zoning, of t he
Albem arle Count y Code, would amend the zoning m ap t o change the boundaries of the Flood Hazard Overlay
District (FHOD). The FHOD exist s for t he purpose of providing saf et y & prot ect ion from flooding by restricting cert ain
uses, development & occupancy of lands w/in the dist rict because they are subject t o inundation by t he waters of t he
one hundred year flood. The dist rict ’s regulat ions also assure that Albem arle Count y will cont inue in t he regular
program of t he National Flood I nsurance Program. The boundaries of t he FHOD are based upon maps result ing
f rom a flood insurance study prepared by t he Federal I nsurance Administrat ion, Federal Em ergency Management
Agency (FEM A) in 1980. Recent det ailed studies by FEMA have resulted in the creat ion of new m aps t hat will
establish revised boundaries of t he lands subject to inundat ion by t he wat ers of t he one hundred year f lood &,
correspondingly, t he boundaries of the FHOD, af f ect ing approxi 4,120 Ps w/in Albemarle County. As a result of t his
proposed amendment t o the zoning m ap, som e Ps, or portions t hereof , will be placed w/in the FHOD, some will be
removed from t he FHOD, som e will rem ain in the FHOD but w/ the FHOD’s boundaries changing, & som e will
remain in t he FHOD but w/ no boundary change. The general usage w/in the FHOD includes certain agricultural &
recreational uses t o public ut ilities & ot her public service f acilities; various wat errelat ed uses such as flood warning
aids, water m onit oring devices, f lood cont rol or environm ental restoration m easures, dams, docks, bridges, ferries,
pum p stations; certain ret aining walls & revetments; hydroelectric power generation; aircraf t land strips; & cert ain
t owers & fences. The FHOD also prohibits t he est ablishm ent of st ruct ures designed or intended f or human
habitation; the storage of various petroleumbased liquids, explosives & other mat erials; the storage of machinery &
vehicles as a primary use; & t he st ockpiling of debris, logs, junk cars & sim ilar materials. The FHOD does not
establish a densit y range, though it does prohibit est ablishing st ruct ures designed or intended for human habitation.
The general usage w/in floodplains described in the Comprehensive Plan discourages development & inappropriat e
uses, t he st ripping of land, & the creat ion of impervious surfaces w/in f loodplain lands because such developm ent
can result in increased danger t o life, healt h & property, increased f lood levels, & degradat ion of water qualit y & the
natural & m anmade environm ent . The Comprehensive Plan does not establish a densit y range w/in the FHOD.
