10. ZTA201500001. Wireless Communications – FC C Mandated Changes. The Board of Supervisors
intends to adopt an ordinance to amend Sec s. 183.1, Definitions, and 185.1.40, Personal Wireless Service
Facilities, of Chapter 18, Zoning, of the Albemarle County Code. This ordinance would implement recently
published federal regulations (47 C.F.R . § 1.40001) by amending Secs. 183.1 and 185.1.40 by adding and
amending definitions and regulations pertaining to the “collocation” of “trans mis sion equipment” on “eligible
s upport structures ,” which must be approved by the C ounty within 60 days unless the colloc ation w ould
result in a “subs tantial change” to the physical dimensions of the eligible support structure; one such
“substantial c hange” arises if the collocation would defeat the “concealment elements of the existing support
s tructure,” a term defined in this ordinance that is not defined in 47 C .F.R. § 1.40001. This ordinance also
w ould amend Sec. 185.1.40 by renaming and reorganizing the section, updating and clarify ing terminology,
amending the procedure to rev iew collocations and replacements that would result in a substantial change
(Tier I review w ith a special exc eption), and amending the procedures for application review and action,
including the time by which applications shall be acted upon (not more than 60, 90, or 150 days, depending
