Dear Cameron,
Please find the revised plans attached within this submission. The plans have been revised to
address comments 1 — 4. The rest of the comments will be addressed after Initial Site Plan
approval has been received with a submission of the Final Site Plan.
A letter to Mr. Bart Svoboda requesting an administrative determination to the code of
development for Belvedere ZMA200400007 is forthcoming. We will address the encroachments
into the ZMA Preservation and Conservation areas. The grounds on which we are requesting
this determination is that we cannot develop this parcel, consistent with the NMD application
plan, and in accordance with current VDOT, Fire Marshall, and ACSA standards. In the letter we
will address a strategy on how we can develop this parcel with minimal impact to the areas and
offer possible solutions on moving forward. The letter was delayed to ensure that the request
matched the plans and represents the least impacts.
Comments to be addressed prior to Initial Site Plan approval:
1. Pay the required notices fee of $435.00.
Response: The fee has been paid online.
[ZMA2004-7 Application Plan & C.O.D.] Revise the site plan to no longer show
grading in the "Part 2" of the development and ensure that the grading in the
"Part" 1 area of the development does not impact the site any more than was
expressly authorized in the ZMA Application plan. If grading within `Part 2" is
proposed, then revise the grading in "Part 2" to also no longer show any impacts
to the site that were not expressly authorized in the ZMA Application Plan.
Response: The grading in part 2 has been removed for this Initial Site Plan. The grading for the
second half of the project will be shown on the Road Plan for Phase 3 Block 10 — to follow the
submission of the ISP.
3. [ZMA2004-7 Application Plan & C.O.D.] Revise the plan include the
Preservation and Conservation Open Space area as they were shown on the
Application Plan in Block 10 and the current steep slopes overlay district
(preserved and managed). Address the following:
a. Show the Preservation Open Space and Conservation Open Space, as
shown on the Application Plan, on the site plan. Ensure that Preservation
Open Space is not impacted any more than was expressly authorized in

the ZMA Application Plan.
Response: The Preservation and Conservation open space from the ZMA is shown.
Disturbance to the Conservation area is unavoidable due to the requirements from VDOT and
Fire Rescue.
b. Show the Steep Slopes (preserved and managed) overlay district areas
and ensure each has a hatch that is designated in the legends.
Response: The Steep Slopes preserved and managed overlay district areas are shown on this
submission. The hatches are distinguished in the legend.
c. Remove any "composite" of the ZMA and GIS steep slopes areas and
hatching.
Response: The composite of the ZMA and GIS has been deleted.
d. Remove the "Preservation Easement" shown, which appears to be the
easement being created for the DEQ and is not part of this site plan
review.
Response: The easement has been removed.
e. Ensure that no portion of the Preservation open space is impacted more
than shown on the Application Plan. Also, ensure there are no
improvements shown within the preserved steep slopes area in and
behind Lots 4 and 5.
Response: The Preservation open space is not impacted with this plan. The portion of the
preservation steep slope that is impacted with elements contained in this plan; is within the
limits of the Application Plan.
4. [ZMA2004-7 Application Plan & C.O.D.] Delineate the boundaries of Block 10 of
Belvedere on the site plan, with lines and labels, and ensure all parcels that are
part of Block 10 are included in the site data. Portions of both TMP 61-160R6
and TMP 62-2B are part of Block 10.
Response: The boundaries of Block 10 is indicated with a dashed line on the existing conditions
sheet.
