Under section § 17-900 of the Albemarle County Code, this is your NOTICE TO COMPLY with
the requirements of the Land Disturbance Permit (or Agreement in Lieu of a Plan) for the
referenced project and to immediately take corrective measures to address erosion and sediment
control deficiencies on this property. This Notice to Comply is being issued because of the
following deficiencies:
Deficiency: SWPPP has been updated showing when controls measures were released,
modified or repaired.
Corrective Action: No action required.
Deficiency: Sediment basin has not been installed per approved plan.
Corrective Action: Complete instation of basin and outfall structures as soon as possible.
Deficiency: Some slopes are eroding and need to be stabilized.
Corrective Action: Repair and stabilize eroded slopes.
Deficiency: Not all disturbed areas have been permanently stabilized.
Corrective Action: Permanently stabilize area as project is completed.
Deficiency: Sediment basin has not been installed per approved plan.
Corrective Action: Complete instation of basin and outfall structures as soon as possible.

Corrective Action: Remove sediment from farm pond and upstream waterway as soon as
possible.
Unless subsequently amended in writing by this office, it is expected all of these corrective
measures will be completed by.
Re -inspection of this notice to verify corrective measures will incur a $150 for land disturbing under
VESCP and single-family dwelling units (§ 17-207) or a $250 fee for land disturbing under VSMP (§ 17-
208). Failure to take effective corrective measures will result in a Stop Work Order upon re -inspection.

Comments: Site is still under Notice to Comply until sediment basin is installed. Site has
encountered numerous storms over the last week. Must make sure all controls are
inspected and logged in to SWPPP when repairs are made. Please provide time
line of when basin will be completed. All other repairs must be corrected by date
noted above.
