Subject: SUB202000136 — Timbercreek Farm — Two Lot Subdivision
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat
referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
1. [Ch 14 Definitions] This application does not meet the requirements for a rural
subdivision per Chapter 14: Rural subdivision. The term "rural subdivision" means a type of
subdivision that is located in the rural areas which results in two or more lots for the purpose of
transfer of ownership or building development, such that: (i) each lot created is at least five (5)
acres in area, and (ii) each lot created has at least two hundred fifty (250) feet of frontage on an
existing public street which is part of the primary system or secondary system of state highways.
The application will be reviewed as a two -lot subdivision.
2. [14-203] Fees. A refund will be issued for $161, the difference between the Rural
Division fee ($742) and two -lot division fee ($581).
3. [18-10.4] Frontage. How is the residue of TMP 43-22C getting its frontage? If it is from
Catlin Road, provide the deed book/page showing how Catlin Road is an approved
private street that provides this parcel with frontage.
4. [14-302(A)(10)] Development rights. Provide the development rights for the residue of
TMP 43-22C.
5. [14-302(A)(11)] Instruments. Revise the DB 4906 PG 414 plat reference. According to
Circuit Court documents, this references a different subdivision.
6. [14-302(B)(10] Stream buffers. Label the stream buffer and floodplain more clearly on
Sheet 2. The entire stream buffer area needs to be shown/labeled, even where
overlapping with the floodplain.
7. [14-303(E)] Easements. Label the '30' access easement' over Garth Gate Lane.
8. [14-309] and [14-310] and [14-416] Health Director Approval. Health Department review
and approval of this subdivision plat is required. Provide soils work for review or provide
previous approvals. A primary and reserve drainfield is required on each lot in order for
each lot to have a building site.
