Under section § 17-900 of the Albemarle County Code, this is your NOTICE TO COMPLY with
the requirements of the Land Disturbance Permit (or Agreement in Lieu of a Plan) for the
referenced project and to immediately take corrective measures to address erosion and sediment
control deficiencies on this property. This Notice to Comply is being issued because of the
following deficiencies:
Deficiency: Project has been dormant for longer than 14 days. Temporary stabilizing is needed
Corrective Action: Seed and straw mulch as required by the approved plan and VESCH manual
Deficiency: See comment and photo item 30
Corrective Action: Seed and straw mulch as required to reduce erosion of the slope.
Deficiency: Silt fence observed at time of visit to be under pressure from sediment buildup and
location related to proximity of the toe of fill.
Corrective Action: Remove all buildup from the silt fence, maintain as required, and remove silt
fence from toe. Silt fence is to have a minimum of 6 foot free space between it and the area of
disturbance.
Deficiency: Observed failing measures that will allow downstream damage
Corrective Action: Make corrections necessary to protect downstream properties
Deficiency: None observed at time of visit
Corrective Action: Ensure there is a practice in place.
Deficiency: None observed at the time of inspection
Corrective Action: If there will be a fuel tank onsite or any storage of petroleum, it must be
within a lined containment area.
Deficiency: None observed at time of inspection
Corrective Action: No wash rack or water observed. Install a containment for wash water and
ensure there is a rack and high pressure wash available
Deficiency: None observed, clear evidence of concrete wash directly on the ground.
Corrective Action: Install proper concrete washout.
Deficiency: Observed trash outside of a proper receptacle
Corrective Action: Cleanup all trash and contain to a protected receptacle
Deficiency: See item 54 photo and description
Corrective Action: Fuels and petroleum waste must be within a lined containment area for proper
disposal, as per manufacturer specifications.
Unless subsequently amended in writing by this office, it is expected all of these corrective
measures will be completed by.
Re -inspection of this notice to verify corrective measures will incur a $150 for land disturbing under
VESCP and single-family dwelling units (§ 17-207) or a $250 fee for land disturbing under VSMP (§ 17-
208). Failure to take effective corrective measures will result in a Stop Work Order upon re -inspection.
