Mitchell Traditional Homes of Richmond PO Box 17664 Richmond, VA 23226 RE: SUB 2006 -0021 Foxchase Landing Preliminary Plat Dear Sir: Fax (434) 972 -4126 The Planning Commission granted approval of your request for the following at its March 21, 2006 meeting: Open Space Appropriateness with the following conditions. 1. [13.4.1] A conservation plan as specified in section 32.7.9 must be approved by the Zoning & Current Development Division of the Department of Community Development with a copy of the original conservation plan and all subsequent revisions to be submitted to the Zoning & Current Development Division. 2. [14 -317, 18 -4.7] Submittal of covenants or other such instrument which evidences the establishment of an owners' association and provides for ownership and maintenance of proposed open space. Such document shall be subject to County Attorney review and approval and shall be in accordance with Section 14 -317 of the Subdivision Ordinance - Instrument evidencing maintenance of certain improvements. The preliminary plat is valid for five (5) years from the date it is approved pursuant to Section 14 -228 of Chapter 14 of the Albemarle County Code, provided that the subdivider submits a final plat for all or a portion of the property within one (1) year (March 27, 2007) of the approval as provided in section 14 -221, and thereafter diligently pursues approval of the final plat. After three (3) years (March 27, 2008) following preliminary plat approval, the agent may, after ninety (90) days' written notice provided by certified mail to the subdivider, revoke the approval upon a specific finding of facts that the subdivider failed to diligently pursue approval of the final plat. The failure to officially submit a final plat as provided in section 14 -221 within the one (1) year period shall render the approval of the preliminary plat null and a new application must be filed and processed. Please address all of the requirements and conditions listed below and submit eight (8) tentative plat copies to the Department of Community Development. This letter must be submitted with the tentative plats, as a checklist, to document that you have addressed all requirements or conditions, or the tentative plat will be denied. Erosion and Sediment Control, BMP Stormwater Management, and road plans with the associated applications and fees must also be submitted with the eight (8) tentative Plats. Once the tentative plat is submitted and reviewed you will receive comments from all departments /divisions /agencies that have made comment on the tentative plat. Any further responses must be made directly to each department /division/agency that has further comment. After all aforementioned departments /divisions /agencies have granted a tentative approval, you must verify with the Planner that you may submit the final plat mylar or other media original and any remaining fees to the Department of Community Development. Assuming that the final plat reflects all tentative approvals, signing of the plat will occur within four days. The final plat will be subject to all final plat requirements (Subdivision Ordinance Section 14.206), in addition to the following conditions. The Department of Community Development shall not accept submittal of the final plat for signature until tentative approvals for the following conditions have been obtained. The final plat shall not be signed until the following conditions are met: Zoning & Current Development approval to include: ❑ COMMENT: Review and approval of all applicable items as specified in Section 14 -206 of the Subdivision Ordinance. ❑ COMMENT: All conditions required by the Planning Commission must be met. Engineering approval to include: ❑ COMMENT: Review and approval of all applicable items as specified in the Design Standards Manual, Section 903B. Water Resources approval to include: ❑ COMMENT: The intermittent stream to Lickinghole Basin has been shown along eastern portion of the plat, and it appears that a 100 -foot buffer has been required. The 100 -foot buffer is supposed to be measured from the edge of the stream bank, not the center of the stream. However, given the steep topography and the incised nature of the streams, the stream and the top of the bank may be close. Staff requests that the applicant check this and ensure that the buffer is correctly measured. ❑ COMMENT: Lickinghole creek/basin has a floodplain associated with it, which appears to be very close to 56 -93C. Since the stream buffer is required to be 100 feet from the basin, or include the extent of the floodplain (whichever is wider) staff requests that the floodplain be shown on the plat, and the stream buffer for Lickinghole creek/basin be shown. This will ensure that the presence of the buffer is known and protected in the future. ❑ COMMENT: The plat shows a proposed stormwater management facility within the stream buffer associated with the intermittent tributary. While placement of stormwater maintenance and erosion & Sediment control measures within the buffer can be allowed, it must be determined that there is no other practical location outside the buffer to place the stormwater maintenance facility. If the stormwater maintenance must be placed within the buffer, it should minimize encroachment into the buffer and impacts to the buffer. 2 Please contact Tamera Ambler at 296 -5832 if you have questions or require additional information. Albemarle County Service Authoritv approval to include: ❑ COMMENT: Review and approval of all final water and sewer plans. Please contact Gary Whelan at 977 -4511 if you have questions or require additional information. VDOT approval to include: ❑ COMMENT: Roadway profiles, drainage computations, pavement design calculations, and intersectional sight distances will be required when the final site plan is submitted. ❑ COMMENT: No Sanitary Sewer manholes will be allowed to occupy the travel way. These are acceptable in bike lanes and sidewalks. ❑ COMMENT: The road design needs to stay in the existing 40' ROW (Carlyle Place Extended). ❑ COMMENT: All street intersections require a 50' radius. ❑ COMMENT: Radius for intersections and cul -de -sac need to be shown.
