DECLARATION OF EASEMENT AND DIVISION RIGHT TRANSFER
This DECLARATION OF EASEMENT AND DIVISION RIGHT TRANSFER
(hereinafter, the "Declaration") is made this I I+t of axne , 2020, by FREIDA
E. FIFE and. ANTHONY A BASSIGNANI (hereinafter, the "Declarants"), whose

("Additional Declarant') - whose address is
WHEREAS, the Declarants are the owners of a parcel of land known as Albemarle
County Parcel ID # 03900-00-00-017A4; and
WHEREAS, Albemarle County Parcel ID # 03900-00-00-017A4 is being
subdivided by the Declarants into Lot 1 A and Lot 1 B, as shown and described on a plat by
Roger W. Ray & Assoc., Inc., dated February 21, 2020, which is attached hereto and
incorporated herein (hereinafter, the "Plat"); and
WHEREAS, Declarants wish to declare a perpetual non-exclusive access easement
for the benefit of Lot I and Lot 1B over and through that portion of Lot I and Lot IA,
respectively, on which the Street is located, as further shown on the Plat;
WHEREAS, the access easement shown on the Plat is to be a new 30-foot-wide
non-exclusive ingress and egress easement (hereinafter, the "Street") for the use and benefit
of Lot lA and Lot I shown on the Plat; and
WHEREAS, Declarants wish to transfer one development right from 03900-00-00-
017A4 to 03900-00-00-017AO and Additional Declarant joins in this Declaration to
consent to the same.
NOW, THEREFORE, for and in consideration of the premises and the undertakings
contained herein, the Declarants hereby impose the following obligations upon Lot I and
Lot 113:
DECLARATION OF EASEMENT. The Declarants do hereby DECLARE, on behalf
of its successors and/or assigns, that Lot IA and Lot 113 shall be burdened by a

perpetual and non-exclusive access easement over and across Lot 1B and Lot 1A. as
more particularly shown on the Plat as "New 30' Private Street Easement." The
location of the Easement and travelway within shall not be expanded in width nor may
the intensity of use be increased.
2. DIVISION RIGHT TRANSFER: Declarant does hereby GRANT and CONVEY to
Additional Declarant one division right pursuant to the attached Plat. Additional
Declarant joins in to consent to the transfer of said division right.
