Staff has reviewed your initial proposal to establish outdoor sales/storage/display of vehicles in
association with a new automobile dealership at the southwest corner of Rt. 29 and Rio Road.
Comments that are available at this time are listed below. As you know, the ARB will review this
proposal on September 8, 2020. Once we have the ARB's recommendation on the proposal, we
will be able to recommend whether the proposal is able to move forward to the Planning
Commission, or if issues should be resolved prior to public hearing.
Plannin¢
Initial comments on how your proposal generally relates to the Comprehensive Plan are
provided below. Comments on conformity with the Comprehensive Plan are provided to the
Planning Commission and Board of Supervisors as part of the staff report.
The Comprehensive Plan shows this area as Core Area within the Rio29 Small Area Plan
(SAP). This designation is intended to have a mixture of uses including residential,
commercial, retail, office, institutional and employment uses in buildings with heights of
3-6 stories, built close to the street, with pedestrian access and relegated parking. The
outdoor display of vehicles along Rio Road and Rt. 29 does not support the primary
goals of the Rio29 SAP. However, staff recognizes that the applicant proposes to occupy
an existing site and building, and that relegated parking and buildings of human scale
would not be possible without significant redevelopment of the site. Also, the addition
of landscaping and street trees is supportive of recommendations in the SAP for
increasing tree canopy and encouraging natural features with development, and this
additional landscaping would help bring existing streets closer to compliance with
recommended street sections. Furthermore, the removal of the drive-thru window
would help support a walkable environment by reducing auto -oriented forms of
development.
The Comprehensive Plan (Chapter 2, Natural Resources and Cultural Assets) also
establishes the goals for preserving the scenic resources that are essential to the
County's character, economic vitality and quality of life. The Entrance Corridor Overlay
District is intended to support that goal by maintaining the visual integrity of the
County's roadways. The Architectural Review Board addresses potential adverse
aesthetic impacts in the Entrance Corridors by applying the County's Entrance Corridor
Design Guidelines during their review of development proposals. The ARB will review
the subject request for conformance with the Design Guidelines on September 8, 2020.
The ARB's recommendation to the Planning Commission will be available after that
meeting.
Zoning
Kevin McCollum in the Zoning Division of Community Development has recommended standard
conditions of approval for this request addressing: 1) general accord with the concept plan, 2)
storage and display of vehicles limited to the areas indicated on the concept plan, 3) no elevated
vehicles, and 4) lighting and landscaping subject to ARB approval.
Current Development
The following comments have been provided by Megan Nedostup and will need to be
addressed with the site plan amendment.
1. The screening shrub requirement (32.7.5.9.e) is not being met in one area where the
parking spaces come right up to the sidewalk. 5' is the standard shrub spacing. Alternatives
may be possible, but the larger the gap, the more difficult it will be to mee the intent of the
oridinance.
2. County GIS shows the parking to the south and dumpster on the adjacent parcel.
3. A minor site plan amendment will be required.
Engineering and Water Resources
The following comments have been provided by Frank Pohl, County Engineer:
1. If land disturbance exceeds 10,000 sf, this project will be considered "development on prior
developed lands", which must meet water quality design criteria in 9VAC25-870-63 in
addition to water quality and quantity standards.
2. The brownish color hatch for the perpendicular parking fronting Rio Road and Seminole
Trail on Sheet 1 of 2 doesn't appear to be included in the legend. Are these display spaces?
3. Indicate the width of the one-way drive aisle on the plan and sections. Also, it appears the
one-way aisle changes width, please confirm.
Note, also, that engineering will apply alley standards for the one-way aisle width.
Fire/Rescue
The following comments related to fire/rescue issues have been provided by Shawn Maddox:
No objection.
Building Official/Inspections
The following comments have been provided by Micheal Dellinger: Any comments will be at
site plan and builicing review, no objection.
Entrance Corridor
The Architectural Review Board will review this proposal on September 8, 2020 and you have
been provided information required to access the staff report for that meeting. Formal
comments from the ARB regarding Entrance Corridor impacts of the proposal will be available
after the meeting.
Albemarle County Service Authority
The following comments have been provided by Richard Nelson: 1680 Seminole Trail is
currently connected to public water and sewer. Developer will need to confirm if there will be
changes to proposed fixture counts.
Rivanna Water and Sewer Authority
Dyon Vega with RWSA submitted comments indicating that no issues or red flags were
identified with the proposal.
VDOT
A letter from Adam J. Moore, P.E. with VDOT (below), indicated that the proposal was reviewed
and found to be generally acceptable. Mr. Moore noted that a VDOT Land Use Permit will be
required prior to any work in the right-of-way.
Community Meeting
A community meeting was held for this proposal as part of the virtual Places 29 — Rio
Community Advisory Committee meeting on August 27, 2020.
SP Conditions
At this point in the review process, we anticipate that staff's recommended conditions of
approval for the Special Use Permit will include those conditions recommended by the
Architectural Review Board. The points of inconsistency with the Rio29 SAP will be identified as
factors unfavorable (and the points of consistency will be identified as factors favorable).
Additional/alternate factors and conditions may be identified as review progresses.
Action after Receipt of Comments
After you have read this letter and we have the opportunity to consider the ARB's action,
please take one of the actions identified on "Action After Receipt of Comment Letter" which is
attached.
Resubmittal
If you choose to resubmit, please use the attached form and note the resubmittal date schedule
(attached). There is no fee for the first resubmittal. Additional notification fees will not be
required unless a deferral takes place and adjoining owners need to be notified of a new date.

ACTION AFTER RECEIPT OF COMMENT LETTER
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the Community Development apply for pages. Be sure to
include the resubmittal form on the last page of your comment letter with your submittal.
The application fee which you paid covers staff review of the initial submittal and one
resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee
Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request
an indefinite deferral. Please provide a written request and state your justification for
requesting the deferral. (Indefinite deferral means that you intend to resubmit/request a
public hearing be set with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning Commission. However, we
do not advise that you go directly to public hearing if staff has identified issues in need of
resolution that can be addressed with a resubmittal.
After outstanding issues have been resolved and/or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with
the Planning Commission's published schedule and as mutually agreed by you and the County.
The staff report and recommendation will be based on the latest information provided by you
with your initial submittal or resubmittal. Please remember that all resubmittals must be made
on or before a resubmittal date.
By no later than twenty-one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See
attached Fee Schedule) Your comment letter will contain the actual fees you need to pay.
Payment for an additional newspaper advertisement is also required twenty-two (22) days prior
to the Board of Supervisors public hearing.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The
only exception to this rule will be extraordinary circumstances, such as a major change in the
project proposal by the applicant or more issues identified by staff that have not previously
been brought to the applicant's attention. As always, an applicant may request deferral at the
Planning Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.

Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule
your application for a public hearing based on the information provided with your original
submittal or the latest submittal staff received on a resubmittal date.
Fee Payment
Fees may be paid in cash or by check and can be paid on line and at the Community
Development Intake Counter. Make checks payable to the County of Albemarle. Do not send
checks directly to the Review Coordinator.
