Subject: SUB202000113 JPA Tower Investors, LLC— Boundary Line Adjustment Plat
The County of Albemarle Planning Division will recommend approval of the plat referenced above once the
following comments have been satisfactorily addressed. (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further
review.): [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning
Ordinances unless otherwise specified.]
5. [Comment] Please note that this plat is only for a boundary line adjustment and the final site plan
comments require easements to be created (Please see comment for SDP2020-44). If it is preferred
that these easements be added to this plat, instead of provided in a separate plat, coordinate with the
planning reviewer prior to resubmittal to ensure the correct fees and applications are provided.
Rev. 1: Comment not vet fully addressed. Easements, required for the site plan, have been added to
this plat. Therefore, the type of plat and the fees are different. Address the following:
a) Submit an application for an Easement with Deeds with required signatures and information.
b) Pay the additional required fees. An Easement with Deeds has a fee of $817. Since $215 was paid
when the Boundary Line adjustment was submitted an additional $602 is required. Ensure that
when the fee is submitted that a note is included stating that this is the additional fee required for
changing the type of plat that is under review.
c) See new comments below in reference to the easements that were added to the plat on the
second submission.
6. [Comment] See the attached comments from most of the other reviewers. As mentioned above, this
plat has been distributed to ACSA and their comments will be forwarded when they become available.
Approval from the other reviewers are required prior to plat approval. Also, please note that the CDD
Inspections comment should be addressed as soon as possible because their review of the requested
items could generate more comments that need to be addressed prior to the approval of the BLA or the
Final Site Plan. Please contact the building plans reviewer (specified in the comment) in reference to
this as soon as possible.
Rev. 1: Comment not vet fully addressed. CDD Inspections and RWSA have "no objections". The
ACSA's d RWSA "no objections" were forwarded to the applicant in early and mid -July. However, the
2"" submission of the plat added proposed easements not previously included. Therefore, their review
is still required. ACSA's 2nd submission comments are pending and will be forwarded to you when they
have been provided. Engineering comments are attached.
Rev. 1: (NEW COMMENT 14-302A (4) & (5)1 Easements were added to the plat on the 2n' submission.
Address the following comments in reference to those easements:
a) Ensure that the easements shown match those shown in the final site plan.
i. The "New 20' Private Drainage Easement" shown coming from the front of the building to the
bottom left property corner of the parcel ("D43") is shown on the site plan to be a sewer
lateral location and not a drainage pipe.
ii. The same easement specified directly above is centered on what the final site plan (5/11/20)
shows as an "existing 4" sanitary sewer lateral to be replaced with a new 6" PVC sewer
lateral". Please ensure that no easement already exists in this location, since a sewer line
already exists there.
iii. Please ensure that the easements for both the existing drainage pipes and the proposed
drainage pipes are "proposed" easements. Although it may be CAD error on the site plan, the
drainage easements shown for both existing and proposed drainage pipes are shown in both
the existing conditions sheet and the grading and drainage plan on the 5/11/2020 submission.
b) Please ensure all plat requirements for the final site plan are coordinated and submitted where
required. Comment #11 from the final site plan (5/29/2020 from Chris Perez) states a "proposed
access & parking easement" will be required prior to approval final site plan. If that easement is
still a requirement of the Final Site Plan approval either add it to this easement plat or submit a
separate easement plat. Ensure any agreements required with such an easement are submitted
for review.
c) Address engineering comments in reference to the addition of easements as well as the
deeds/agreements required with the proposed easements.
d) There does not appear to have been another submission final site plan since the comments
provide on 5/29 (and later). This plat has been compared to the 5/26/2020 submission (5/11/2020
plan date). Any revisions to the site plan that are made to address the comments from the FSP
reviewers may necessitate additional comments on this plat in the future.
8. Rev. 1: (NEW COMMENT 14-302 (All Revised the name of the subdivision to include the easements
added in the second submission.
9. Rev. 1: NEW COMMENT 14-303 (A)l Revised the statement of consent to division to include the
addition of the easements added in the second submission.

3. Revise public drainage easement widths per ACDSM easement width diagram, p. 15 (20' is minimum public drainage
easement width), link to ACDSM: https://www.albemade.org/Home/ShowDocument?id=270 .
4. Revise table caption (or create new table) to reference courses along SWIM facility easement (dedicated to public use,
proposed dry retention basin): D29 — D36.
5. Provide retaining wall easement with recorded agreement (Albemarle not party to Agreement) since proposed new
boundary appears to locate portions of existing retaining wall on two commonly held parcels that may be separately owned at
some point in the future. Comment traces to building inspections requirements, county building inspections is aware wall is
existing.
6. Engineering recommends ownership data for adjacent properties. 14-302(A)15 may provide sufficient basis to request
data (Name, deed bk.-pg.) be displayed on the BLA for T.M. 60-25 and CSX Transportation, Inc. Engineering defers to Planning.
7. Revise plat title to reference easements as well as boundary line adjustment since plat establishes private /public
drainage easement, SWM facility easement, and public utility easements.
8. SWIM facility easement requires deed. Engineering will format deed once SWIM facility Maintenance Agreement is
recorded (ref. also WPO202000030 review comments, 7/17/20, review item 3).
9. Public drainage easement requires deed of dedication of easement. Engineering will format deed once Maintenance
Agreement is recorded.
