The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-302 (A)(4)] Please indicate whether there are any existing private easements on Tax Map Parcels
(TMPs) 122-33 and 122-36.
2. [14-302 (A)(5)] Please indicate whether there are any existing public easements on TMPs 122-33 and
122-36.
3. [14-302 (A)(10)] Please seethe attached Letter of Determination (LOD) regarding the number of
development rights available to TMP 122-33. Please make the following changes to the plat:
a. Revise the note stating that TMP 122-33 has five (5) development rights so that it states TMP
122-33 has four (4) development rights.
4. [14-302 (A)(11)] Please state The deed book and page number of the instrument whereby TMP 122-36
was created, as recorded in the office of the clerk of the circuit court of the county.
5. [14-302 (A)(15)] Please add two notes stating the names and address of the owners of recorded for both
TMP 122-33 and 122-36.
6. [14-302 (13)(5)] Revise the zoning note so that it states the zoning for each parcel separately.
7. [14-302 (13)(7)] Please revise the notes related to water supply watersheds and agricultural -forestal
districts. A separate note should be provided for both TMPs 122-33 and 122-36 stating whether each
property is within a water supply watershed or agricultural -forestal district.
a. TMP 122-33 is located within the Carter's Bridge Agricultural -forestal district. This includes
the 2.1 acres that will be transferred to TMP 122-36. Per the County Attorney's office, the 2.10
acres will remain within the Carter's Bridge Agricultural -forestal district after the BLA is
recorded. Be sure that the plat contains a note stating that "The 2.10 acres being transferred to
TMP 122-36 is located within the Carter's Bridge Agricultural -forestal district."
8. [14-302 (13)(1)] Please add a date of last revision.
9. [14-303 (D)] Please revise the acreage calculation for TMP 122-36. There is an extra digit in the
existing acreage (6) and new acreage (8) figure that should be removed.

The County Attorney and I have reviewed the title information for the above -noted property, it is
the County Attorney's advisory opinion and my official determination that Tax Map 122, Parcel
33 is one (1) parcel of record with four (4) theoretical development rights. The basis for this
determination follows.
Our records indicate Tax Map 122 Parcel 33 contains 64.84 acres and one (1) dwelling. The
property is in the Carter's Bridge Agricultural and Forestal District.
The most recent deed for this property, recorded prior to December 10, 1980, the date of
adoption of the Zoning Ordinance, is recorded in Deed Book 377, page 53 and is dated March
22, 1962.

On the basis of these deeds Tax Map 122, Parcel 33 is determined to be a 64.84ac
parcel containing four (4) development rights.
The parcel is entitled to the noted development rights if all other applicable regulations
can be met. These development rights may only be utilized within the bounds of the
original parcel with which they are associated. These development rights
are theoretical in nature but do represent the maximum number of lots containing less
than twenty one acres allowed to be created by right.
If you are aggrieved by this determination, you have a right to appeal it within thirty days
of the date notice of this determination is given, in accordance with Section 15.2-2311 of
the Code of Virginia. If you do not file a timely appeal, this determination shall be final
and unappealable. An appeal shall be taken only by filing with the Zoning Administrator
and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the
appeal. An appeal application must be completed and filed along with the fee of $120.
The date notice of this determination was given is the same as the date of this letter.
