HomeMy WebLinkAboutSUB201900150 Review Comments Easement Plat 2020-09-15County of Albemarle Department of Community Development Memorandum To: Earl Mottley, WW Associates From: Tori Kanellopoulos — Senior Planner Division: Planning Services Date: September 15, 2020 REV 2 Subject: SUB201900150 — Stonefield Block— Easement and Subdivision Plat dated 08/16/2019 (Planning comment #6 revised after additional input from Planning staff, Engineering comment #2 added after discussion with County Attorneys Office) The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] If no action is taken within 6 months of receiving these review comments, the application will be deemed withdrawn. Planning (Tori Kanellopoulos) NEW [14-303(A)] Signature block. Please revise signature statement to exactly match the following from the easement plat checklist/ordinance. Other statements may be moved to the notes section of Sheet 1: "The platting or dedication of the following described land [insert a correct description of the land subdivided] is with the free consent and in accordance with the desire of the undersigned owners, proprietors and trustees, if any." 2. [1 Since this plat has been resubmitted as both an easement plat and a subdivision plat, submit the fee for easement plat and deed review ($817) along with the next plat resubmittal. a. REV 1: Addressed. 3. [14-302(B)(1)] Date. Revise the date based on the most up to date resubmittal: The date of drawing, including the date of the last revision. a. REV 1: Addressed. 4. [14-302(A)(1)] Name of plat. Revise the name of the plat to include that it is also an easement plat, not just a subdivision plat. a. REV 1: Addressed. 5. [14-302(A)(9)] Building site note. Revise Note 7 on Sheet 1 to the following: New Parcel Block D-1 and the residue of Tax Map Parcel 061W-03-00-019A0 each contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance. a. REV 1: Addressed. 6. [14-302(A)(3)] Existing streets. Include the full language for the access easements and sidewalk maintenance easements for District Avenue per DB 4135 PG 221, which includes "Reserved for Dedication Upon Demand of the County." a. REV 1: Partially addressed. This language needs to be included for the adjusted NEW 9.50' SIDEWALK NAAOEMMCE EENT RESERVED FOR DEDICATION UPON DEMAND OF Tiff CODNr (TTPI.'.AL; sidewalk easement as well. b-. REV 2: Label the street as follows: 'District Ave private street easement - ROW reserved for dedication upon demand of the County'. 7. [14-3C, .all existing easements on each sheet of the plat. For example, the DB/PG for the existing power easement, ACSA easements, and gas line easement are not consistently shown. Ensure the most recent DB/PG for each easement is shown. a. REV 1: Addressed. 8. [14-302(A)(4)(5)] Easements. Ensure consistency between the final site plan (SDP202000024) and this easement plat. a. The plat shows the existing ingress/egress access easement for Inglewood and Bond being adjusted; however, the final site plan shows the access easement for District being adjusted. b. The final site plan does not show the new easement for the filterra/SWM. c. REV 1: Addressed. The easement plat and final site plan now appear to match. The final site plan will be reviewed again after the easement plat has been approved/recorded to ensure final consistency. 9. [14-302(A)(4)(5)] and [14-303(E)] Easements and Dimensions. Full dimensions of the new ACSA water line easement do not appear to be shown. a. REV 1: Addressed. 10. [14-302(A)(4)(5)] Easements. Label sign easement as "need'. a. REV 1: Addressed. 11. [14-302(A)(4)(5)] Easements. Revise Note 6 to be "need' instead of "existing" ACSA easements. a. REV 1: Addressed. 12. [14-302(A)(4)(5)] and [14-303(E)] Easements and Dimensions. Provide dimensions (metes and bounds) for all new and existing easements, including those being abandoned or adjusted. a. REV 1: Addressed. 13. [14-302(A)(4)(5)] Easements. Sheet 1 lists the following easements as "new", however they do not appear to be shown on the plat. Please clarify: new public utility easement; new public storm drain easement; and new sanitary sewer easement. a. REV 1: Addressed. 14. [14-430(B)] ACSA dedication. Include a note on the plat that public water and sewer facilities are dedicated to ACSA: The facilities to be dedicated and the easement to be established shall be set apart on the final plat and shall be identified by a note on the plat stating that the facilities are dedicated to, and the easement is established for, the service authority. a. REV 1: Addressed. 15. [14-317] The existing maintenance documents will need to be amended for the adjusted ingress/egress easement and sidewalk maintenance easement. a. Use the attached checklist when submitting maintenance documents per 14-317. Indicate where in the existing covenants or in the updated/amended covenant the requirements are being met. b. REV 1: Indicate where in the existing covenants (section or page number) the maintenance of the sidewalks and ingress/egress is covered. Indicate how these covenants will be updated. 16. [14-431] The new SWM easement requires a deed, to be reviewed and approved by Engineering and the County Attorneys Office. Engineering staff will provide this deed. a. REV 1: Comment remains. See Engineering comments. b. REV 2: Comment remains. Engineering (John Anderson) 1. With no objection to plat per -se (no requested revisions to linework, notes, etc.), CAO has notified Engineering that a deed of dedication is required for WPO202000016 and WPO201100055, since Master Declaration for Stonefield Development does not convey public easement. Email dated 09/09/20 to applicant: "a determination has been made. A new SWM Agreement is not required, but it appears that a deed is required for the Filterra." VDOT (Adam Moore) 1. No objection.
