Dear Mr. Messing:
The Board of Supervisors approved your rezoning application on June 7, 2006. Your rezoning
from CO (Commercial) to C-1 (Commercial) was approved in accordance with the attached
proffers dated May 26, 2006. A proffered plan of development entitled "Site Layout for the
Shops at Rio Road", prepared by Hurt & Proffitt Incorporated, dated June 27, 2005 (sheet 2 of
2) was approved as part of the rezoning. Please refer to these documents for any future
applications and requests on this property.
Please be advised that although the Albemarle County Board of Supervisors took action
on the project noted above, no uses on the property as approved above may lawfully
begin until all applicable approvals have been received and conditions have been met.
This includes:
· compliance with applicable PROFFERS;
· approval of and compliance with a SITE PLAN; and
· approval of a ZONING COMPLIANCE CLEARANCE.

Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the Owners
or their duly authorized agents hereby voluntarily proffer the conditions listed below which shall
be applied to the Property, if rezoned. These conditions are proffered as part of the requested
rezoning and it is agreed that: (1) the requested rezoning itself gives rise to the need for the
conditions, and (2) such conditions have a reasonable relation to the rezoning requested.
1. The Property will be developed in ~ner~...accord with the plans entitled "~
Layout for the Shops at Rio Road," prepared by Hurt & Proffitt Incorporated,
dated June 27, 2005 (sheet 2 of2), a copy of which plan is attached hereto as
Exhibit A (the "Plan"), except that the size of the retail space and the restaurant
space within the proposed 15,180 square foot building referenced on the Plan may
vary relative to each other, provided that the square footage ofthe building does
not increase.
