Under section § 17-900 of the Albemarle County Code, this is your NOTICE TO COMPLY with
the requirements of the Land Disturbance Permit (or Agreement in Lieu of a Plan) for the
referenced project and to immediately take corrective measures to address erosion and sediment
control deficiencies on this property. This Notice to Comply is being issued because of the
following deficiencies:
Deficiency: Large areas of denuded areas present at time of visit.
Corrective Action: Stabilize as required by program. Seed, fertilizer, and mulch
Deficiency: Observed stockpile without stabilizing and perimeter controls at site visit.
Corrective Action: Stabilize as per VESCH minimum standards
Deficiency: Diversion ditches not stabilized and eroding along channel bottom
Corrective Action: Seed and straw mat to prevent scour
Deficiency: Trap and basin need to be cleaned out of sediment.
Corrective Action: Maintain all traps and basins as required by the VESCH manual, seed and
mat inner walls of trap and basin, repair heavy scour damage at basin.
Deficiency: Trap and basin need to be cleaned out of sediment. Over 50 percent of capacity

VESCP and single-family dwelling units (§ 17-207) or a $250 fee for land disturbing under VSMP (§ 17-
208). Failure to take effective corrective measures will result in a Stop Work Order upon re -inspection.

Comments: Seed and mulch all open areas, only leave bare the minimum needed to work
current stage. Dip all sediment from trap and basin, seed and mat sediment buildup
between Route 20 and the trap and basin. Clean rip -rap at trap. Install cut off ditch
to route some of the additional runoff away from the trap and into the basin as
discussed on site. Protect stockpile above trap with silt fence and seed -straw
mulch.install matting along all ditch line bottoms to prevent scour. Repair and seed
mat interior walls of basin. Overseed any existing seeded areas to ensure
adequate coverage to prevent sediment runoff.
