RE: SUB202000123 Belvedere Phase 5A - Easement Plat
Dear Cameron,
We have received the comments for the above referenced project dated July 24, 2020. Please
note, for clarity I have shown the proposed right of way with calls and ties. I think it should
make it much clearer if anybody had to re-create the easements later rather than tying all the
way back out to the exterior boundary. Below are responses to the comment letter:
1. [14-302 (A)(3)] Update the label for the existing portion of Fowler Street on Sheet V2 that states the
instrument number for the plat that dedicated the ROW.
Response: DB/PG added.
2. [14-302 (A)(4)] See Engineering comments below. Please show the private access
easements for retaining walls.
a. [14-302 (A)(14)] Per Engineering comments, retaining wall easements will be private.
Add a note stating the size and acreage of the easements, and who will own and maintain
them to Sheet V 1.
Response: Easements added on sheet V2. See note 13.
b. [14-317] Provide HOA documents indicating ownership and maintenance
responsibilities for the retaining walls.
Response: Comment passed on to attorney. Will forward once received.
3. [14-302 (A)(4), 14-302 (A)(5)] See Engineering comments below. Show and label all temporary
construction and grading easements and indicate whether they are public or private in the
callouts on Sheet V2.
a. Public easements should include the words "hereby dedicated to public use" in the
easement labels.
Response: Easements added on sheet V3.
4. [14-302 (A)(4), 14-302 (A)(5)] Please show the proposed 40' access easement and indicate
whether it will be public or private in the callout on Sheet V2.
Response: Easement added on sheet V3.
5. [14-302 (A)(5)] Please indicate whether the new variable width SWM easement is public or
private on Sheet V2.
a. Public easements will require submittal and review of a deed of easement. Please contact
Engineering Division reviewer to confirm that the SWM easement will be public. If so,
Engineering will provide a deed of easement template that should be completed and sent in
with the next plat submittal.

b. Public easements should include the words "hereby dedicated to public use" in the
easement labels.
Response: Labels added to public easements.
c. [14-302 (A)(14)] State the total acreage of the public easement in a note on Sheet V I.
Response: As far as I know, showing acreage of easements is not a requirement in the
code. The reference is regarding land that is being dedicated. Let me know if that is not
correct and I will add area calculations.
6. [14-302 (A)(11)] Please state the instrument numbers that created the existing Lots 196-201 outside
of Phase 5A which are visible on Sheet V2.
Response: DB/PG reference added.
7. [14-302 (A)(15)] Per recorded instrument in DB 5088, pages 605-608, TMP 62-16D is subject to a
50' and 70' wide ingress and egress easement. Show this easement on the plat and add a note
stating the names and addresses of the easement holder. State the recorded instrument number in
the easement label on Sheet V2.
Response: The access easements mentioned in the deed are for Dunlora Road and
provide access to the site, but are not located on the site. I have attached a better copy
of the plat at DB 875 pg 331 for reference. The one on the County site was really hard to
read.
8. [14-302 (13)(5)] Revise note 7 on Sheet V 1 as follows:
a. Clearly state that TMP 62G-7-C is zoned NMD Neighborhood Model District and is
subject to the proffers and Code of Development of ZMA200400007.
Response: Zoning note updated. Additional parcels included in this plat have also been
added to the note.
9. [14-302 (B)(5)] Revise note 8 on Sheet V 1 as follows:
a. State that the portion of TMP 62A3-1 that is zoned NMD Neighborhood Model
District is subject to the proffers and Code of Development ofZMA200400007.
Response: Zoning note updated.
10. [14-302 (B)(5)] Please revise Note 9 on Sheet VI as follows:
a. Remove reference to the DBIZ. DBIZ is not an official overlay zoning district and should
not be included in the note.
b. TMP 62-16D is not subject to ZMA200400007. Please remove reference to the ZMA in
the note.
Response: Zoning note updated.
11. [14-302 (B)(10)] No stream buffers are visible on the plat. Please verify why Note 6 is included
on Sheet V 1. Remove if necessary.
Response: Note removed.
12. [14-302 (13)(5)] Revise the zoning note on Sheet 1 as follows:
a. Clearly state that TMP 78-20M6 is subject to the proffers and Application
Plan of ZMA200100015.
b. State that the property is within the EC Entrance Corridor Overlay District.
Response: I'm guessing this note was meant for the Presidio plat?

13. [14-302 (13)(1)] Please add a date of last revision.
Response: Revision date added.
14. [14-303 (A)] Please revise the statement of consent to division for TMP 62A3-1 on Sheet V I. The
TMP number is wrong, it should be TMP 062A3-00-00-00100.
Response: Label updated.
15. [14-303 (E)] See Engineering Division comments below. Public drainage easements need to be
re- sized. The dimensions in the table on Sheet VI will need to be updated to comply with the
revised easement size.
Response: Drainage easements have been updated per the revised Site Plan.
16. [14-303 (F)] In the labels for Lots 196-201 to the west of Phase 5A, please state the section/block
number for those lots in the labels on Sheet V2.
Response: DBIPG reference added.
Engineering Comments:
1. Please show the sight distance easements.
Response: Sight distance easements have been added sheet V2.
2. Please show the private access easements for the retaining walls.
Response: Wall access and maintenance easements have been added sheet V2.
3. Please show the temporary grading & construction easements.
Response: Temp. grading and construction easements have been added sheet V3.
4. Please show the 40' access easement.
Response: 40' access easement added sheet V3.
4. Please show retaining wall access easements. Please provide HOA agreement docs for the maintenance
with the plat prior to approval.
Response: Wall access and maintenance easements have been added sheet V2. Attorney
will draft HOA does. I will forward once received.
5. Please size the drainage easements to the required width following the drainage easement width
calculation: 10'+(pipe dia. or channel width) + 2'+ 2(depth-5').
Response: Drainage easements widths have been updated per the revised Site Plan.
Note: Table measurements subject to change.
