Subject: SUB-2020-144 Countryside Subdivision Lots 6 + 7 — Boundary Line
Adjustment
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat
referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
[14-302 (A)(5) & 14-303(L)] Public Easements; Public utility, drainage and sight distance
easements. Show all existing public easements and provide labels for the owner and the
deed book and page number of the deed and easement. If a specific location for the
easement is not specified in the deed or plat that created it then include the information
(easement, owner, deed book and page number) in a note on the coversheet. There is
an overhead utility shown crossing both properties. Provide the required information for
that easement in a note on the cover sheet for each of the two parcels.
2. [14-302 (A)(9)] Building sites on proposed lots. Revise the required building site note.
TMP 84-64E has a building site that complies with section 4.2.1. TMP 84-64F does not
meet the minimum requirements of that ordinance, since there is not a 30,000 SF
rectangular area within the parcel, currently or after the BLA, that is not impacted by the
WPO buffer. Therefore, the current not is not complete or correct. Revise the note to
have two separate portions.
a. The note you have provided can be revised to only be for TMP 84-64E to state,
"Tax Map Parcel 84-64E contains a building site that complies with sections 4.2.1
of the Albemarle County Zoning Ordinance."
b. Add a second section which states, `Tax Map Parcel 84-64F does not contain a
building site (as specified in 4.2.1) and is a nonconforming lot as specified in 6.4."
3. [14-302 (A)(10)] Right of further division of proposed lots. Add the required right of further
division note, `Parcel (letter or number] is assigned [number] development rights and
may/may not be further divided and when further divided these rights shall not comprise
more than [number] acres. The residue of Tax Map/Parcel [numbers] is retaining
[number] development rights and when further divided it shall not consist of more than
[number] acres." Each parcel has one (1) development right since they existed before
1980. They do not have more development rights because of their size. Please note that
because of their size these parcels may not be further divided. Ensure you include that in
the note. Therefore, the note should state, "Parcel 64E and 64F each are assigned 1
development rights and may not be further divided."
