RE: [SDP 2005 -124: Fontaine Avenue Townhouses]
Dear Mr. Pohl:
The Planning Commission granted approval of your request for the following waiver and action:
Waiver of Section 4.2.3.2 of the Zoning Ordinance to allow disturbance of critical slopes;
Approval of pedestrian connection as required by condition of ZMA 2004 -002.
The Department of Planning and Community Development hereby grants administrative approval to the
above - referenced site plan.
The approval of the preliminary site plan is valid for (1) one year in accordance with Zoning Ordinance
Section 32.4.3.1. Therefore, the preliminary approval shall expire January 26, 2007. If the preliminary site
plan approval expires, a new application must be filed and processed.
Please address all of the requirements and conditions listed below and submit eight (8) tentative plan copies to
the Department of Planning and Community Development. This letter must be submitted with the tentative
plans, as a checklist, to document that you have addressed all requirements or conditions, or the tentative plan
will be denied. A submission and review schedule is attached for your information.
The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan, with the associated
applications and fees, may also be submitted with the eight (8) tentative Plans. Failure to do so will result in a
separate application to be filed with the Engineering Department at a later date.
After the initial tentative plan submittal, each department /agency will contact you to discuss any remaining
conditions. After all aforementioned department /agencies have granted a tentative approval, you may submit
the final mylars (1 set), two paper copies, final site plan application, final site plan fee, and a copy of all
written tentative approvals to the Department of Planning and Community Development by 5:00 p.m. on any
Monday. Assuming that the final site plan mylars reflect all tentative approvals, signing of the plans will
occur four days later {Thursdays).
The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in
addition to the following conditions.
The Planning Department shall not accept submittal of the final site plan for signature until tentative
approvals for the following conditions have been obtained. The final site plan shall not be signed
until the following conditions are met:
A. Engineering Department approval to include:
1. The parking spaces along Morey Creek Court need to be less than 5% grade in any direction. [18-
4.12.15c]
2. Please label dimensions of the parallel parking spaces. It appears that the parking spaces do not
meet the minimum required width of 9' at the spaces along Morey Creek Court. [18- 4.12.16c,
32.6.6g]
3. Please label the proposed curb radii at the entrance to Fontaine Avenue. [18- 32.6.6e]
4. The entrance landing to the site from Fontaine Avenue needs to be at a grade of 4% or less for at
least a minimum of 40'. [18- 4.12.17b]
5. Please show and label a 140' wide construction easement at the end of Morey Pond Court that
allows the proposed retaining wall to be removed at a later date so interparcel connection can
occur at this point. [18- 32.7.3]
6. Please show and label an additional 30' construction easement at the end of the Morey Creek Lane
that allows the road to be connected to TMP 76 -12D for a future interparcel connection. [18-
32.7.3]
7. Please show the variable easements along Morey Creek Court to the southern property line to
encompass all the proposed improvements. [18- 32.5.6i]
8. Please provide a table on the plan and profile sheets that describes the type of drainage structures
that correlates to each drainage structure number shown on the plans. [18- 32.6.6d]
9. Please provide safety slabs for the drainage structures that exceed 12' in depth. [DM 505E]
10. Please provide a signed and dated professional seal on the final pedestrian bridge plans. [18-
32.6.1 ]
11. Please provide a signed and dated professional seal on the drainage computations. [ 18- 32.6.1 ]
12. Please label the dimensions of the proposed turn and taper at Fontaine Avenue. [DM 604, 905]
13. Please show the required grading required for the construction of the pedestrian bridge and the
entire sidewalk on the final site plans. [18- 32.6.6b]
14. Please note that a Special Use Permit is required for any fill activities that would occur in the
floodplain for this construction activity. [18- 30.3.03.2]
15. The engineering review for current development needs to review and approve all applicable items
as specified in the Design Standards Manual, section 902, before giving approval to the final site
plan.
B. Albemarle County Building Codes and Zoning Services approval to include:
1. Approval of final site plan parking specifications.
C. Any Other Conditions, Which May Be Appropriate:
1. Virginia Department of Transportation approval of pedestrian path, as path will ultimately be
maintained by VDOT.
