STAFF: Dougherty, Cilimberg PLANNING COMMISSION DATE: April 11, 2006 BOARD OF SUPERVISORS DATE: June 7, 2006 OWNER / CONTRACT PURCHASER The owner is Wachovia bank represented by Steve Messing of Unicorp National Development. Steve Messing will be unable to attend the Board hearing. In his absence, Valerie Long will represent the owner. PROPOSAL: The applicant is requesting a rezoning of 1.836 acres (the Wachovia Bank property) from CO to C-1 to allow for redevelopment of two properties: the parcel being rezoned and the adjacent parcel (zoned C-1) at the corner of Rio Road and Route 29. Specifically, the applicant would like to replace the Rio Road Superette and Heritage Memorials of Charlottesville with a new restaurant of 4,300 square foot restaurant and 11,000 square feet of retail. A rezoning of the bank property would be followed by a boundary line adjustment and the purchase of about one acre of land from the bank to support the developer's plans for the adjacent property (Rio Road Superette and Heritage Memorials). Appendix I is the Planning Commission Staff Report, including the rezoning plan and renderings. BACKGROUND: When the Planning Commission reviewed this request on April 11, 2006, a recommendation for approval was forwarded to the Board of Supervisors so long as a commitment to the plan proposed was made. Appendix II is a proffer committing to the plan the Commission reviewed. DISCUSSION/FINDINGS: The applicant is proposing a plan that responds well to the principles of the Neighborhood Model, Entrance Corridor Guidelines, ARB recommendations, and the C-1 zoning classification. The proffer committing to the plan provides assurance that the rezoning will result in an improved condition at this prominent intersection. RECOMMENDATION: Staff recommends approval.
