Wickham Pond

The applicant requested two variations to the plan, which have been reviewed and are
approved as follows:
One variation involves the relocation of all tot lot equipment from the front of the site to
the rear of the site. The approved plan shows the tot lot near the front of the site. The
builder believes having the tot lot at the front of the site would not be a very attractive
amenity for the entrance of the development; therefore he prefers to have the tot lot at the
rear of the site on an area approved for park use. The front of the site where the tot lot
will move from will remain open space. The existing relocated smokehouse will remain
at the front of the site also, and the open space may be used for gardening and youth
activities.
• Section 8.5.53 (a.2) allows the director to grant a variation of an approved plan for
changes to the arrangement of buildings and uses shown on the plan, provided that the
major elements shown on the plan and their relationships remain the same. The following
list answers the five criteria used to determine that this variation request is acceptable:
The variation is consistent with the goals and objectives of the comprehensive plan,
The variation does not increase the approved development density or intensity of
development.
The variation does not adversely affect the timing and phasing of development of any
other development in the zoning district.
The variation does not require a special use permit.
The variation is in general accord with the purpose and intent of the approved
rezoning application,
The second variation the applicant is requesting is a reduction of sidewalks shown in
front of the existing house from two (2) sidewalks to one (1) sidewalk. The approved plan
shows a formal area in terms of the paths and landscaping. The Architectural Review
Board requested that this area be less formal and that it have an appropriate connection to
Route 240, which is in front of the house. The reduction in sidewalks and less formal
plantings will help create a less formalized space.
• Section 8.5.5.3 (a.4) allows the director to grant a variation of an approved plan and
allows minor changes to landscape or architectural standards. This change is minor and is
therefore acceptable. The following list answers the five criteria used to determine that
this variation request is acceptable:
The variation is consistent with the goals and objectives of the comprehensive plan.
The variation does not increase the approved development density or intensity of
development.
The variation does not adversely affect the timing and phasing of development of any
other development in the zoning district.
The variation does not require a special use permit.
The variation is in general accord with the purpose and intent of the approved
rezoning application.
