Dams are managed by the Virginia Dept of Conservation and Recreation.
Except for some very large ones, almost all agricultural ponds in
Virginia are exempted from regulation. If this dam evolves from
agricultural to some other use, it may be regulated. If the dam is on
the conservation parcel, I believe they could easily claim it is
maintaining an agricultural use.
I will ask staff to verify which parcel would contain the dam.
The following is taken from DCR's web page:
All dams in Virginia are subject to the Dam Safety Act unless
specifically excluded. A dam may be excluded if it:
is less than 6 feet in height;
has a capacity less than 50 acre -feet and is less than 25 feet in height;
has a capacity of less than 15 acre -feet and is more than 25 feet in
height; is used for primarily agricultural purposes and has a capacity
less than 100 acre -feet (should use or ownership change, the dam may be
subject to regulation); is owned or licensed by the Federal Government;
or is operated for mining purposes under 45.1 -222 or 45.1 -225.1 of the
Code of Virginia.
The height of a dam is defined as the vertical distance from the
streambed at the downstream toe to the top of the dam.
The capacity of a dam is defined as the volume capable of being impounded
at the top of the dam.

Paul, I'm new to the issues involved in this particular dam, but as one
who lives downstream from a dam that is in poor condition (and will be a
huge expense to the upstream subdivision), I'm sympathetic with your
general message. By cc: of this message, I'll ask staff to update me and
see what we can do to make sure we don't create a monster.

Finally some common sense is allowed when it comes to planning in our
county. My name is Paul Accad and I've lived in Glenmore for 11 years.
I am interested in Glenoaks because Don Franco of KG Associa. wants to
add it to Glenmore and in order to have an informed opinion about that I
am trying to follow the twists and turns of Glenoaks approval process.

Imhoff, He said he thought it was possible that the lake was 25 feet
deep and needed to come under state regulation,, Ed also said the dam
needed MAJOR work. ,,,,,Don Franco said he did not think it was a
regulated body of water. I think the county needs to determine with
certainty if this lake is a regulated lake or not. The main reason I
would like to see state oversight is that the dam needs major repair, and
I would like to see the Army corps of engin. or the state oversee those
repairs not Don Franco. As you know, if the repairs are not done
properly now, future residents of Glenoaks and maybe Glenmore and
maybe the county will be on the hook for the bill. Now is the time to
fix this problem for the next 50 -100 years. So in conclusion, I
believe the county has a duty to ascertain who will oversee the repair
work on the dam and the first step on that path is to determine how deep
the lake is and if it is a regulated body of water or not Thank
