Dear Ms. Higgins,
This letter is to inform you that your letter of revision request for changes to site plan SDP201300029, as
show on the attached plan and letter, has been denied. The changes requested and those observed onsite
exceed the criteria for a letter of revision. See the attached site plan amendment policy for more
information. Changes to the project's phasing and the combination of changes surpassing a "de minimis"
review were the primary considerations leading to this decision. Therefore, the County is upholding its
original guidance for the changes to this development to be submitted as a minor site plan amendment.
Such guidance was provided via email to the applicant and owner on July 28, 2020. If you would like the
fee for this LOR to go towards the application fee for the minor site plan amendment, provide a written
request to me no later than 10 days after the minor site plan amendment is submitted.
As guidance for a future minor site plan amendment, the County offers the following review comments.
Note that the following comments are those that have been identified at this time. Additional comments
may be added or eliminated based on further review.
1. Generally, it was found that materials submitted do not match the as -built conditions of the site. As
examples, differences in the paving materials, plantings at the entrance, and light fixtures were observed.
These, and any other differences between the approved site plan and as -built conditions need to be
incorporated into the site plan amendment. Ensure that the materials submitted to the County match the
desired as -built conditions. This is paramount.
2. The narrative submitted with the application materials indicates that changes to the approved plan are
happening at both the initial and final phases of the site's development. As such, the site plan amendment
will need to include revised plan sheets for both the Initial and Final Phases. See Sheets 5 and 9 of the
approved plan attached.
3. When revising the aforementioned Initial and Final Phase sheets (Sheets 5 and 9), clarify the following:
(Note: These changes were not included in the application materials but should be incorporated.)
a. How the sidewalk installation will be phased. It appears the as -built sidewalks seem to be a
combination of the two approved phases, instead of one or the other.
b. When and where parking spaces will be installed. It appears the as -built condition constructed
parking -ready areas in the Initial Phase, however, these spaces are not yet lined. These areas
should be marked for parking in this phase. Ensure the parking schedule and notes on the revised
plan sheets are updated accordingly.
c. Include the above -ground gas meter at the site entrance on the site plan sheets.
4. The approved Initial Phase sheet indicates that an existing 1-1/2 story frame building located in front of the
Car Wash facility was supposed to remain in place. However, this building has been demolished. The site
plan amendment will need to include revised Demo Plan sheets to show the building's removal in this
Initial Phase, instead of the Final Phase. See Sheets 4 and 8 of the approved plan attached.
5. The revised Landscaping Plan sheet for the Initial Phase did not appear to match the as -built condition of
the site. Note, changes to the landscaping also need to be reflected in the tree canopy coverage calculations.
6. If light fixtures are being added and/or located away from previously approved locations, as appears be the
case in the as -built condition, a revised Photometric Plan for the Initial Phase is needed. See Sheet 7 of the
approved plan attached.
7. The amendment proposes a revised vehicular circulation around the Car Wash building, specifically one-
way circulation around the west side of the building and two-way circulation around the east side of the
building. Delineate where one-way circulation ends and two-way circulation begins and provide the
appropriate signage. An agreeable option for the Initial phase is one-way circulation around the entire Car
Wash building with one-way traffic control signage at the southeast comer of the Car Wash building.
8. For your awareness, the minor application will include more Site Committee Reviewers, thus more
comments may be identified during that review.

1. What is the purpose of the 50'-long fence?
2. Increase the variety of added shrubs so that no single shrub species accounts for more than 25% of the total
shrub count.
3. Revise the plan to clearly show the extent of the added juniper. Confirm that the juniper is in addition to the
abelia.
4. The plan shows new gas service along the EC street, but this wasn't listed in the list of changes. Provide
dimensions of the gas service. Ensure that the added landscaping (currently proposed as 3 abelia, 30" tall at
planting) will eliminate visibility from the EC, or propose alternate screening.
5. The casual style of plan notations makes the proposal somewhat unclear. Be sure all as -built changes and
all proposed changes are shown clearly on the plan and included in the written list of revisions. Additional
comments may be generated when the plans are further organized and clarified.
6. If architectural changes have been made or are proposed to be made, submit an ARB application for an
amendment to the approved Certificate of Appropriateness.
Staff has provided references to provisions of Chapter 18 of the Code of the County of Albemarle. The
Code is kept up to date by the County Attorney's office. The Code may be found on the County
Attorney's website which may be found under "Government" at Albemarle.org.

OVERALL GOAL — To adjust the area included in the Initial phase for improved access and
make more attractive to EC. Minor changes.
This is to request that this be handled as a Letter of Revision because the changed items are
minor in nature and the phase area adjustment is to based upon the approved site plan layout
with no design changes. (The entrance is completed and is now "existing" — therefore no
VDOT review is appropriate for this LOR to be approved)
Minor items:
a. Privacy Fence — Approved site plan shows fence 1001f on west boundary that starts at the
first island in parking along West edge to end at the end of the 201f fence at rear of 10x20
dumpster. This is to change the end point to coordinate with other fencing — end to be at
corner of dumpster on adjacent property. Total length to be 501f. Fence to be installed in
Final Phase.
Justification: The slope grading was coordinated with adjacent property owner to flatten the
slope as much as possible so the property line bisects the slope. Installing a fence will impact
maintaining the juniperus plantings that have been added. If left as is, the fence will overlap
with the 201f rear section of dumpster fence (leaving only 1 Oft between) and overlap with the
adjacent property dumpster fence (leaving approx.. 15ft between). With 6ft high fences that
are 10 - 15ft apart, the strip between will not get enough sunlight for grass/plants to survive.
b. Concrete Island located between the 1s' & 2nd wash bay (west end of bldg) is reduced to 52"
Justification: This island is between the 2 self service bays and is not needed as the entrance
to the self service bays is recessed at the rear of the bldg. A short island is sufficient to keep
vehicles separated and matches the other islands between bays at the front of the bldg.
c. Island at the Center front of the Bldg is added/adjusted to coordinate with bldg. 52" x 19'1 ".
Justification: This island was not shown on all the site plan sheets — some showed no island.
The final installation matches the length of other 2 islands across the front and the width is
slightly wider to coordinate with the wash bay openings on either side of the island.
d. Landscaping — ADD sixty (60) juniperus/blue rug or Youngstown plants 3 gallon size to the
landscaping along West edge between property line and parking. This is to provide
stabilization on the slope and more attractive appearance to EC. ADD three (3) abelias in the
island at the front center of Auto Laundry. (See Sheet 6)

Minor Phase Details:
Include an expanded area in Initial Phase: The portion of the site between RT240 and
the Auto Laundry and area adjacent to the Auto Laundry on the East side of the bldg to
be included in the Initial Phase. This is to resolve 2 significant issues:
1 Site Access is improved by including the new entrance in the initial phase. Three
(3) existing entrance locations have been closed and one (1) new entrance
constructed. The new entrance is completed per the final design. A VDOT permit
was obtained, work completed, inspected by VDOT, and release letter is attached.
Safety is improved by eliminating the confusion of having barricaded entrances
along RT240.
2 All drainage structures between the Auto Laundry & RT 240 have been installed so
no change to drainage design.
A small area adjacent to and on the east side of the Auto Laundry bldg has been
added to the Initial Phase to correct an issue with showing a travelway over the
underground water recycle system tanks. The tanks are to be protected inside the
"island" but the island was omitted in the initial phase layout. The area is
constructed per the final phase design with tanks located in the island adjacent to
the bldg. The "temporary' 24 ft wide travelway is shifted over to avoid the island.
This temporary connection completes the circulation around the bldg for this phase
and will be removed once the full parking lot is constructed in the Final phase. A
temporary concrete curb has been added to define the travelway and handle
drainage — it will be removed at final phase. (See Sheet 8)
Landscaping: The Initial phase plantings are expanded to include the portion of the
landscaping plan along the west edge associated with the site improvements. In
addition, two (2) additional trees at the rear are added to initial phase. Justification: The
landscaping matches the final phase and provides much more landscaping at an earlier
stage of the development. This eliminates the demo of temporary bushes.

SITE PLAN AMENDMENT POLICY

Changes to site plans are permitted per the regulation in Section 32.3.8 of Chapter 18 of the
Albemarle County Code. This policy establishes how and when a change can occur to an
approved Final Site Plan.
Changes that frequently arise after Final Site Plan approval vary in scope and detail. Staff
has established a tiered policy that addresses the degree of change(s) and the level of review
required to facilitate such change(s).
You must discuss any proposal for change/modification with a Planner or Permit Planner
prior to submittal of your request for review. The Planner or Permit Planner will determine
if the change meets the criteria established for a Letter of Revision or a Minor Site Plan
Amendment.
It is at the County's discretion to determine whether a change or modification qualify for a
LOR or a minor site plan amendment.
Letter of Revision (LOR): is considered to be a change to an approved final site plan that
is not significant enough to constitute the need for a minor site plan amendment. (SEE
LOR POLICY)
2. Minor Site Plan Amendment (MINA): is considered a site plan amendment that proposes
changes beyond the criteria outlined for a Letter of Revision. (SEE MINOR
AMENDMENT POLICY)
Major Site Plan Amendment (MAJA): is considered a site plan amendment that proposes
changes beyond the criteria outlined for a Minor Site Plan Amendment.

LETTER OF REVISION (LOR) POLICY
Letter of Revision (LOR): is considered to be a change to an approved final site plan or most relevant
plan that is not significant enough to constitute the need for a minor site plan amendment.
2. You must discuss any proposal for change/modification with a Planner or Permit Planner prior to
submittal of your request for review. The Planner or Permit Planner will determine if the change meets
the criteria established below.
3. LORs apply to an approved Final Site Plan. An approved final site plan is a plan that contains the
signature block and all of the appropriate signatures from the County and other reviewing agencies.
4. It may be determined that a proposed LOR can apply to an approved minor site plan amendment instead
of the approved Final Site Plan. A minor site plan amendment is an approved plan that contains a
Planner's signature or stamp of approval.
5. Only three (3) LORs may be approved for a Final Site Plan before a new minor amendment must be
submitted for approval that incorporates all of the changes approved with the LORs.
Any change that does not constitute a permanent physical change to the site (examples: farmer's market,
food truck, location of affordable units) will not count toward the maximum number of LORs.
2. Any proposed change must meet all applicable regulations.
3. No additional adverse impact on adjacent properties or public facilities
5 Criteria Categories for LOR
These criteria are provided as a guide and are not to
be considered an exhaustive list of potential changes
Building/structure changes
- addition to building of 200 sgft or less
o deck additions on commercial site plans
o main building
- addition of accessory structures of 200 sgft or less
- add/remove loading dock(s)
- not construct the connector roof between the addition and the existing building
- add porch roofs at entrance(s) into the building
Landscaping & Screening changes
- quantity and or species change complying with the approved plant list and approved canopy
calculations (See Section 32.7.9)
Parking changes
- restriping of spaces
- addition or subtraction of up to 3 spaces provided that this would not exceed the maximum number
or fall below the minimum number of spaces allowed per Section 4.12.4(a)
- consolidate/move HC spaces (See Section 4.12.4(b))
- add/remove or adjust curbing
- add/remove CG-12 ramp (See Section 4.12.4(b))
Lighting changes
- See attached table (on next page)
Other Hardscapes
- add/remove sidewalk(s) or walkway(s)
- add propane tank(s) above and below ground and associated pad(s)

MINOR AMENDMENT POLICY
Minor Site Plan Amendment (MINA): is considered a site plan amendment that proposes changes beyond the
criteria outlined for a Letter of Revision.
Criteria for a minor amendment
Proposal would be for:
1. An existing structure that is 10,000sgft or less, the addition shall not be more than 30% of the structure,
2. An existing structure that is 10,001+ sgft the addition shall be no more than 3,000sgft,
3. Moving, adding, or removing phase line(s),
4. Reducing the building size that results in additional site alterations that cannot qualify for a Letter of
Revision,
5. Changing the location of landscaping,
6. A change that would not result in any activity that requires a waiver or modification,
7. A change that would not result in a new or modified entrance,
8. A change that would not increase the available impervious area to an extent that additional on -site
stormwater management facilities are required,
9. A change that would not violate conditions of prior approvals and,
10. A change that does not require and application for ARB approval.
Three (3) MINAs may be approved for a Final Site Plan before a new Major Amendment must be submitted for
approval that incorporates all of the changes approved with the LORs and MINAS.
MINOR AMENDMENT CHECKLIST
Final Site Plans approved prior to 5-1-87 that are proposed to be changed with a minor amendment must include
the applicable site plan content requirements of Section 32.5 and 32.6. (See checklist online or obtain a paper
copy from the main office). If content required by sections 32.5 and 32.6 is requested to not to be provided then
a site plan waiver must be processed.
1. Appropriate application filled out and fee paid.
2. Plan is prepared and sealed, signed and dated by an architect, professional engineer, land surveyor, or
certified landscape architect, each of whom shall be licensed to practice in the Commonwealth of
Virginia.
3. Final Site Plan number that the amendment applies.
4. List of the proposed changes.
5. Graphic delineation of the proposed changes (bubble, other symbols).

Dear Jo:
The County has received your variation request referenced above for modification to
exceed the maximum building height requirements of 35 feet for Three Notch'd Center
without a corresponding increase to the setback. Your specific variation request is to
allow up to a maximum of 39.5 feet for the proposed 3-story west building while
maintaining the 30 foot building setback. (Ref. Zoning Ordinance Section 21.4)
Section 8.5.5.3 allows the director of planning to grant minor variations to yard
requirements and maximum structure heights as long as:
1) The variation is consistent with the goals and objectives of the
comprehensive plan.
This is the applicant's response to the Architectural Review Board's request that this
building be designed with a pitched roof in order to meet Entrance Corridor guidelines.
Maintaining the integrity of the Entrance Corridor roadways Is a strategy of the
comprehensive plan.
2) The variation does not increase the approved development density or
intensity of development.
This variation request allows flexibility in roof design of the 3-story west building, but does
not increase density or intensity of the approved Three Notch'd Center development.
3) The variation does not adversely affect the timing and phasing of
development of any other development in the zoning district.
This variation does not affect timing or phasing of development.

This is a minor variation request and is in keeping with the purpose and intent of the
approved rezoning application to allow redevelopment of the Three Notch'd Center
property -
Based on the above findings, this letter serves to provide APPROVAL of an increase in
the building height of up to 40 feet without a corresponding Increase to the 30 foot
setback as depicted on the approved Application Plan, subject to Architectural Review
Board (AIRS) approval. This approval does not supersede any authority of the ARB or
any other provisions of County ordinances applicable to this project.

GENERAL GON5TRUGTION NOTES FOR 51TE PLANS
I. Prior to any construction within any existing public right-of-way,
including connection to any existing road, a permit shall be obtained from the Vir�inI
Department of Transportation (VI50T). This plan as drawn may not accurately re lest the
requirements of the permit. Where any discrepancies occur the requirements of the permit
shall govern.
2. All paving, drainaqe related materials and construction methods shall conform to current
sppecifications andstandards of the Gity of Gharlottesvllle unless otherwise noted.
3. Erosion and siltation control measures shall be provided in accordance with the approved
erosion control plan and shall be installed prior to any clearing, grading or other
construction.
4. All slopes and disturbed areas are to be fertilized, seeded and mulched. The maximum
allowable sloe Is 2:1 (horizontal: vertical). Where reasonably obtainable, lesser slopes
of 3:1 or better are to be achieved.
5. Paved, rip -rap or stabilization mat lined ditch maL{ be required when, 1n the opinion of the
the Engineers, or the Engineer 's designee, It Is deemed necessary
in order to stabilize a drainage channel.
6. All traffic control signs shall conform to the Virginia manual for Uniform traffic Gontrol Devices.

8. All excavation for underground pipe installation must comply wlth OSHA Standards for the
Gonstruction Industryy (2a GFR Part IG36).

I. Areas on which fill is to be placed shall be cleared, grubbed, and stripped of topsoil. Soil materials shall be free of
debris, roots, wood scrap material, vegetation, refuse, soft unsound particles and frozen deleterious or
objectionable materials. The maximum particle diameter shall be one-half the lift thickness. Maximum particle
diameter shall be one-half the lift thickness. Gommon fill material shall be unclassified soil material with the
characteristics required to compact to the soil density specified for the intended location. Backflll and fill

with a minimum 5-foot separation from public water mains and sanitary gewer.

GENERAL UTILITY NOTES
I. Gontact Miss Utility at I SOO 552 7001 48 hours prior to any grading or dlc1ging to have underground utilities marked.
The contractor shall verify all utility Information prior to constructlon to include type and sizes of pipe and services to
his own satisfaction.
2. All existing utilities shown on this plan have been taken from available records. The contractor is required to dig test
pits in advance of trenching in order to determine the exact location and elevation at crossings. If a conflict is
discovered, notify NP Engineering at 434-531-7387. Prior to beginning installation of utilities, contractor shall verify
inverts at all connections with existing utilities prior to purchasing or ordering any precast structures.
3. All hyydrant locations to be approvedby the Albemarle Gounty Frre Marshal prior to final approval by the county and

4. All blasting requirements to Tnstall utilities shall require a permit and shall be performed in accordance with the Albemarle

Construction & Installation
A. Each unit shall be constructed at the locations and elevations according to the sizes
shown on the approved drawings. Any modifications to the elevation or location shall
be at the direction of and approved by the Engineer.
B. If the Filterra'o is stored before installation, the top slab must be placed on the box
using the 2x4 wood provided, to prevent any contamination from the site. All internal
fittings supplied (if any), must be left in place as per the delivery.
C. The unit shall be placed on a compacted sub -grade with a minimum 6-inch gravel base
matching the final grade of the curb line in the area of the unit. 'the unit to be placed
such that the unit and top slab match the grade of the curb in the area of the unit.
Compact undisturbed sub -grade materials to 95% of maximum density at +1- 2% of
optimum moisture. Unsuitable material below sub -grade shall be replaced to the site
engineer's approval.
D. Outlet connections shall be aligned and sealed to meet the approved drawings with
modifications necessary to meet site conditions and local regulations.
E. Once the unit is set, the internal wooden fouls and protective mesh cover must be left
intact. Remove only the temporary wooden shipping blocks between the box and top
slab. 'ilic top lid should be sealed onto the box section before backfilling, using a non -
shrink grout, butyl rubber or similar waterproof seal. The boards on top of the lid and
boards sealed in the unit's throat must NOT be removed. The Supplier (Americast or
its authorized dealer) will remove these sections at the time of activation. Backfilling
should be performed in a careful manner, bringing the appropriate till material up in
6" lifts on all sides. Precast sections shall be set in a manner that will result in a
watertight joint. hi all instances, installation of Filterra unit shall conform to ASTM
specification C891 "Standard Practice for Installation of Underground Precast Utility
Structures", unless directed otherwise in contract documents.
F. Curb and gutter construction (where present) shall ensure that the flow -line of the
Filterraa units is at a greater elevation than the flow -line of the bypass structure or
relief (drop inlet, curb cut or similar;. Failure to comply with this guideline may cause
failure and/or damage to the Filterra environmental device.
G. Each Filterra'e unit must receive adequate irrigation to ensure survival of the living
system during periods of drier weather. 'Ibis may be achieved through gutter flow or
through the tree grate.

A. Activation of the Filterra unit is performed ONLY by the Supplier. Purchaser is
responsible for Filterra' inlet protection and subsequent cleats out cost. This process
cannot commence until the project site is fully stabilized and cleared (frrll
landscaping, grass cover, final paving and street sweeping completed), negating the
chance of construction materials contaminating the Filterra system. Care shall be
taken during construction not to damage the protective throat and top plates.
B. Activation includes installation of plant(s) and mulch layers as necessary.
Maintenance
A. Each correctly installed Filterra® unit is to be maintained by the Supplier, or a
Supplier approved contractor for a minimum period of 1 year. The cost of this service
is to be included in the price of each Filterra(V unit. Extended maintenance contracts
are available at extra cost upon request.
B. Annual maintenance consists of a maximum of (2) scheduled visits. The visits are
scheduled seasonally; the spring visit aims to clean up after whiter loads including
salts and sands. `the fall visit helps the system by removing excessive leaf litter.
C. Each maintenance visit consists of the following tasks.
1. Filterra unit inspection
2. Foreign debris, silt, mulch & trash removal
3. Filter media evaluation and recharge as necessary
4. Plant health evaluation and pruning or replacement as necessary
5. Replacement of mulch
6. Disposal of all maintenance refilso items
7. Maintenance records updated and stored (reports available upon request)
D. The beginning and ending date of Supplier's obligation to maintain the installed
system shall be determined by the Supplier at the time the system is activated. Owners
must promptly notify the Supplier of any damage to the plant(s), which constitute(s)
an integral part of the bioretention technology.

CONSTRUCTION
The luminaire consists of a cast Room-
nim ballast housing and spun aluminum
reflector housing, seal -welded together
for a one-piece unit. The lens choices are
flat glass, sag glass, acrylic half sphere, or
acrylic drop globe. All hardware is stam-
less Steel.
INSTALLATION
The top of the l wninairc mounts to
E urotiq ue ant plumbizer. The 4" diam-
eterarm is recommended. The globe is
gaslreteA and mounted on an aluminum
ring which is hinged to the reflector
housing and furnished with a captive
screw for easy relamping. The reflector
shall pivot and be secured with a cap-
tivescrew for easy access to the bat last
a ssembly. The ballast and scdcet assem-
bly is furnished with a quidrdisconnect
plug and mounts on a removable ballast
plate.

The luminaire has a powder coat finish

process whch consists of drying, powder
application and curing. BAforeccatlng,
the parts are treated with a fivestage
pretreatment process, consisting at a
heated alkaline cleaner, rinse, phosphate
mating, rinse and sealant.

I. The planting layout shall be consistent with the layout shown on Sheet 11.
2. Planting shall be limited to the period between September 15 to
November 15, or March 15 to le 50. Landscaping shall be seeded and
planted during the first period following completion of site development.
