I looked at all the information with Amelia and we have come to the following conclusions — that
Garth Gate Lane and Yellowwood Drive are Private Streets giving frontage to the proposed east
and west lots. Catlin Road (which would serve Parcel X) is a Private Street also. However, its
approval does not extend Parcel X and provide it with frontage. (It borders the street but does not
have access to it based on the family division plat approved for the adjacent propert .) Based on
these findings in order for this plat to be approved it must be processed as a Subdivision Plat as
required by Chapter 14, Section 206. This section spells out the review process and plat
contents. You may of course submit this plat as a preliminary first and after receiving approval of
it submit the final for signature or you may submit directly as a final. In either case Planning
Commission review will be required. This is due to the need for the Planning Commission to take
action on three specific sections of the ordinance. Those sections are Chapter 14, Section
232(A) (for approval of Catlin Road as a Private Street), Chapter 14, Section 412(A) (for
modification of street standards) and Chapter 14, Section 404 (to allow the east and west lots to
access streets other than a private street established at the time of the subdivision, Catlin being
the street established at the time of the subdivision). The fee you have paid $95 can be applied
to the subdivision plat application fee of $720. A groundwater assessment is not required as all
of the proposed lots are over 21 acres.
